So I having recently finished work experience at a garage with good aspects for an apprenticeship decided to take a nice relaxing ride today along the east neuk of Fife. Those of you who have ridden along it knows its quite nice with great views of the sea and twisty village streets that remind one of renaissance Italy. So as I was traversing this familiar stretch of tarmac I came across a Suzuki Alto traveling at an inconveniently slow pace. I would have ridden past it and left it in my dust but as luck would have it there was a constant stream of cars coming the other way. So I follow them poised for the overtake until we arrive at Anstruther. I look to the left at a rather lovely sports coupe and suddenly a wild traffic light appeared and the alto braked hard. And in my daze I did not squeeze the brake with the force of a pair of the jaws of life, so into the back of it I went. I reeled for a moment as my chest hit the handle bars. An elderly man leaped from the car in his stylish ray bans and swiftly approached the rear of the car.
"I'm okay, I'm sorry" I weezed.
"Frankly I don't care if you're okay!" He snapped.
He carefully inspected the area that my front tyre hit. I told him we needed to get off the road, so we parked up and out of the car stepped his equally elderly missus who was minutely more sympathetic. The rear of the bumper has cracked paint and its popped off of its push in mounts at the rear wheel arch. The bikes completely fine though (whoop whoop). We exchanged details and he mentioned getting a quote for the damage and me just paying for it, instead of going through the insurance as it would skyrocket my premiums. (I was completely at fault I think and was completely reasonable and calm at the scene Cool )

So my question is! Do I give him money or go through insurance?

TL:DR I bumped the back of a car so hard a singularity was created.

White knuckle, stomach dropping MS paint diagram to follow if backed by popular demand.

You'll pay, he'll go through insurance for whiplash.

Insurance won't go up too much, wouldn't worry about it.

I suspect that depends on if he wants a brand new bumper that'll need spraying or if he just wants the cracked paint to be resprayed and that'd be it.

And if one of the bumper push in mounts has broken then he'll be wanting a new bumper.

See what he comes back saying.

The collision was only at 15mph at the most so I think he'll have a hard time passing that off Wink

get an agreement in writing that the 'debt' of the damages of the incident are settled in full so he can't claim later through insurance

There's a few folks on here familiar with legal terms and stuff like that, there's also Paddy who's crashed nearly as many times as the DVLA have taken him to court (many times)

When you've got the agreement written up, copy and paste it here (without names) and people will make pointers on how to improve it.

It might not be 100% legally water-tight but it should make life very difficult if he attempts to put a claim in later

Insurance is there for this purpose, use it. Keys everything some and if o or when it goes tits up it's the insurance job to get it sorted.

It entirely depends on whether you think he'll Jew Scotch you out and put in a claim for whiplash anyway.

If you think not, pay up. There's no point in getting him to sign anything, his ambulance chaser will just deny it later anyway.

If you think he'll bawww, then either stop talking to him and tell your insurer to handle it, chop-chop, or deny being in the area / country / continent / planet at the time.

Go through insurance otherwise....

2yrs down the line there will be a much bigger claim against including injuries for the 15 disabled passengers you didnt see that he was transporting to a kitten caring fun day.

I will never give up on biking! Though I will be more careful in future considering there were actual consequences this time and not just some cracks in the plastics haha. I'm planning on taking lessons soon so I can pass my test so I'm sure they will help.
