Questions after write off

Hi all

As the title says we're after some info. My son got rear ended by a post office van and they have now written his cbr125r off. When we bought the bike it was already classed as a cat c , he's had the offer from post office including getting the bike back but we don't know the right way to get the paperwork sorted.
We'll be doing the work ourselves ( looks like rear wheel , no.plate indicators and poss. swingarm ) and we have read on here that once the works done it can be used as long as it has a mot - does it need to redone as it was mot'd about a month ago , is this right ?, but we don't know what else needs to be done. Can anyone point us in the right direction please ?

Hi

The rules for cars are a bit more complicated, which does cause confusion. For bikes there is no need for another MOT as Pete says, or a vehicle identity check.

However it might be worth an MOT for peace of mind and as some basic proof that it was safe.

I've likely got those parts that you can have for a few quids plus postage. Courier is likely a tenner, 15 max and I've got wheels and swingarms galore.

Should say these are early cbr125 bits

As said, there is nothing to the paperwork side.

I would recommend a bit of caution around the mechanical side. If the impact was strong enough to damage the swingarm, then frame damage is a possibility. At the very least, get all of the plastics off and inspect the frame for any damage. Pay particular attention to any welded areas for cracking.

If you need to replace the swingarm, you should also replace the spindle that mounts it to the frame and its bearings, which will have taken plenty of force.

If the writeoff money is good, I would prefer to go down the route of breaking it for parts rather than putting it back on the road. A bike never feels right after a big crash.

Agree with robby for the most part. It never does feel the same afterwards. However if it's a frame you need... Laughing

The bike is an 04 cbr , my son was at a roundabout , moved forward slightly and the po van moved a lot further ( impact of about 10 - 15 mph ) the damage we could see was the no. plate , indicator on one side and the rear wheel developed a wobble / clunk / shake if you grab the top of it and rock it across the frame ( before the accident we were already thinking about changing the bearings in the rear wheel - and we think the bump has damaged them completely )
When we pick the bike up I'll be getting a full report once the po stop farting about and actually pay the storage fee's
When we bought the bike it was already classed as a cat c and he likes the bike a lot ( more than the cbf that is his replacement bike ) and We're not worried about working on it , what I wasn't sure about was do we have to send the log book in to dvla ? as much as anything , my son may have found somewhere to get the bits but thanks for the offer and I might end up getting back to you

Keep the log book. Send nothing to dvla.

Indeed, it's got the square root of sod all to do with them. "Write off" is an insurance fiction with no basis in any statute or regulation that I've ever seen.

My son was in a similar situation just before xmas, the other drivers insurance wrote it off but we bought it back for a song, and fixed it for a smaller song, the lad's insurance company asked if we could get an mot on it ( it was less than 3 years old) just to make sure it was safe then they'd be happy to carry on insuring him on it, it's not a law thing as I understand it, just a thing that some insurers seem to want done.

Fair enough in the former case - they're doing him a favour - but laugh it off in the latter.

Looks like PO have caved in and are paying all expenses , should be picking up the bike next week when the monies gone through to Kestral
