A local NHS trust has posted a letter with "Strictly Private and Confidential" on it. The failed to put any name on it, so it just had my address.

They've kindly posted me one of their employees sickness records, reasons for sickness and details of disciplinaries. Not sure why I would be interested in knowing this.

Now, knowing what HR departments are like, I'd hate for this to go silently under the carpet, equally I know how I'd feel if someone had randomly posted these details of mine to someone else. Livid doesn't come close.

Who would be the best person to make aware of this blatant and careless breach of confidentiality? ICO? DoH?

You should tell the NHS trust that did it (so they know they made a mistake), NHS HQ (so they know their underlings are incompetent) and the ICO (to stop NHS from trying to sweep it under the carpet).

You can also tell one of the rageface newspapers if you feel like seeing it in print (80 words, on page 15).

I would just stuff it through the shredder. You have no idea of the circumstances behind the reason it was mis-sent but you seem to be out to end someone's career because NHS. Might be a single mum of three trying to hold her head above water whilst caring for her ailing mum? Bah, what the hell she deserves to lose her job because NHS.

So someone made a mistake, possibly. Who the hell doesn't? Don't go on a vendetta, either send it back or put it through the shredder. Sounds like the subject of the letter wasn't exactly a model employee anyway.

I had similar with a private company 12 months ago

Got sent someoneeelse's medical records

I contacted the company to let them know they fucked up

They won't lose their job or face disciplinary action if it's reported. Data protection breaches, unless malicious, are treated as training and improvement opportunities.

OP, contact the trust and ask to speak to the Caldicott Guardian - they will make sure the breach is acted on and not covered up.

It's important that breaches are reported - there may have been other mistakes made at the same time and this gives the trust an opportunity to mitigate the impact on individuals.

up until the early 2000's the Police used to fax criminal records to the Crown prosecution service solicitor at home etc..
every now and then you would get calls from places like screw fix direct saying Mr jonny scrote balls records just turned up.

You bet your bottom dollar the CPS lawyer who gave the wrong fax number wouldn't get touched but the Officer who sent it would be disciplined like the POS they are.

Fortunately they do it all by encrypted email these days (probably just as exposed in reality).

Sadly its always the overworked employee that falls on the sword in these cases.

i bought a label printer from ebay ages ago

printer contained a ribbon that had been used up, if you unwound the ribbon you could read (previously printed) patients names an nhs numbers, addresses an shizz

i doubt you could do much with it though?

Why not the person whose name is on the records you received? It's *their* confidentiality that's been breached, not yours.

Write down the person's name, then shred the letter. Phone the people who issued the letter, make them aware of the mistake so they can a) issue the letter again to the correct address and b) try to ensure it doesn't happen again.

I've had this happen to me (though from a Law firm, not NHS) and they were very grateful, and took my word for it that the document had been destroyed. Like Pete said, everyone makes mistakes and we don't know the potential damage that may be caused by interfering.

By dox I'm not just meaning post his name, address, mobile number and name of his cat, you're going to do this more thoroughly which means digging a little bit deeper to get the necessary details for taking out credit and lots of it.
