This happened to me yesterday while out on bike, to go to my local asda, (about 1.5 miles away!) for milk bread and cigs.
I was pottering into town on my bike and i nearly got wiped out...
Bear in mind that i was on the main A road going through town...
Scanning junctions, as one does on a motorbike, junction 50 yards or so to my left
a police car in full livery(a volvo... so traffic?) and an officer in full uniform
behind the wheels... even made eye contact with him... so i thought he's seen me...
and proceeded on my merry way... a split second later he is halfway into my path...
and throws the anchors(bike talk for stopping suddenly)...
So grab a hanfull of brakes and i can feel my fork going lower and lower, and realised i was not going to stop...
So let go of the brakes and made a stunning avoidance manouver, same as i got taught
for my module 1... and while avoiding the car... well the customary horn blast and the V-sign...
I was fuming... next thing i know... blues and two's going up... 100 yards and i am already on
pavement taking my helmet off... even before the officer could starighten the car on the carriage way...
So i wait for him... cig in gob... counting 1, 2, 3, 4, 5,... and so on and so forth...
Officer: do you know why i have stopped you? Me:Yes officer, i do!
Silence... officer: and? Me: aaaand? Officer: don't you try to be smart!(by this point the officer
got a very red colour across his face, and i can see the veins in his neck swelling...)
Officer: i'll ask you one more time, do you know why you have been stopped? his tone is now firm!
Me:Yes officer i do! but before you give me the ticket for s.5 public order... or s.59 police reform act
think for one moment... CCTV(council) are pointing the right way, not only that... but on my bike
there is a front facing camera(nice video BTW!) and i also need to point out that my helmet camera is still recording! I pointed at my helmet cam.
At this point(beggar belief!), the officer tries to grab my helmet cam... and crack... helmet on floor
with a loud thud! so there goes my helmet... at this point I am so furious i could have eaten him alive!
So in a moment of lucidity... Me: get on that radio and call for one of your collegues... criminal damage and all that! i walk away few steps... grab the cigs again... and count... 1, 2, 3, 4, 5,....
Another police car blues and two's arrives, screeching to a hault mere millimetres from volvo, 2 officers
jump out the car barking: stay where you are... (this is getting better and better)one proceed to put cuffs on me...
and i do not resist, i let them have their way... No caution, not even the reason for the cuffs! remember that my helmet cam is still recording.
So in the back of car, get asked my details, I comply, various PNC on my vehicle... checks out... the next thing they said... we are now waiting for a van to go down the police station...(???????????????????????????)
Me(politely): Have i been arrested officer? Officer2: silence... i repeat the same question... no answer!
The van pulls up, i get escorted... i comply... Me: what happens now to my bike? Officer: it will be recovered to a secure compound where you can collect it at a later date. Me: do i have to pay for it? Officer: dunno, speak to the operator. for some strange reasons they give me the helmet... (Nice, memory card is now safe)
So rant over... let the "cool story Bro" pics rip! |

Although... i'd love to call bullshit..as if they arrest you without telling you so and giving you that "anything you do say" gibberish.. I believe you can actually fuck them up the arse...
Only been tugged once when I had an attitude on.. moaning about car being too loud. I gave him the sarcastic remark of "atleast people can hear me, with your fog lights on and lack of driver side brake light, you are more dangerous than myself"
He proceeded to walk back to his car and flash me on my way... I was only in a mood because I just got my front bumper crunched by some cnut who wasnt looking  |

They ask you in the hope that you say "i was speeding/talking on a mobile/getting a blow-job whist driving" thus incriminating yourself and making their jobs easier ("I was stupid/I'm really sorry" can be used as an admission of guilt in court). It also has the double whammy that if you say "I didn't do anything wrong" or "I have no idea" they can try and stick you with driving without due care etc if they're feeling particularly vindictive (as after all, you should always be aware of what you and your vehicle is doing).
I was told the best response to the question "do you know why I stopped you" is: "In the interests of not incriminating myself, I think it best you tell me officer..." or words to that effect. That way you are co-operating with them, observing your rights and not admitting to anything. Also, never agree with anything they say... For example, if the officer tells you that they stopped you for speeding and asks if you understand or have anything else to say, either say "no comment" or "I fully understand that you have stopped me as you allege I was exceeding the speed limit". That way, should it ever come to court, they will have to compile all the evidence etc and make sure that every i is dotted and every t is crossed (proper police work, heaven forbid) to convict you as they cannot use your own words against you.
The only downside to this approach is that it immediately tells the copper that you might be a bit of a smart arse and it may go against you... But between admitting you were at fault and hoping that an apology will get you out of a ticket, or annoying the copper a little and making it a lot more difficult to pin a driving conviction on you, I know which I will go for! ____________________ 1977 Honda CG125

As a man (/boy) who got away with 8-9 absolute throw-the-book-at-him banning offences at the road side, bang to rights. Smart arse is not good. Admission of guilt is not good. Skirting the issue and trying not to look like a dick is the way forward.
And occasional use of big words, that helps. Makes you look educated and separates you from their usual tugs.
As for the OP, whilst they may have been out of line, your initial post screams noob biker at me (anchors is bike talk, 'use an avoidance manoeuvre type 1... would that be 'try not to hit things'... I never got taught that, I'm sorry to say. Picked it up somewhere mind you).
An alternative way to view this event is you were going too quickly, copper pulled out and stopped, you overreacted because of poor observation/road positioning, and then gave it the bunny as you went past. Preaching your rights in that situation will get you thugged. I hate British cops, but you have to know how to deal with them, and you massively failed the attitude test on several counts. Good luck with the case, but in future you may want to revise your approach
Oh, and I don't believe in SMIDSY's either. Just to open that can of worms. At least non-avoidable ones. Why have you been stopped:
Also seems perfectly reasonable 'tactic' to judge the person.
Say someone pulls out on you and the police stop them. I'd hope they got treated differently if they said "no idea why you stopped me, you tell me" to if they said "terribly sorry officer, I misjudged the speed of that motorbike".
I got treated reasonably fairly when I got stopped for a sillyish speed and admitted it as well as telling them a little under the speed they got me at (though more because I didn't want them to see I didn't actually have a speedo .)
Lets say instead of a seat belt, it had been a case of that person having damaged your bike.
He then knocks a policeman down, drives off and doesn't stop for some time despite being pursued by the police. He only stops when they go to deploy a stinger.
How would YOU like that person to be treated?
Seemed he didn't have the wherewithal to be using the roads and deserved what he got for driving when obviously not mentally capable. |
