Hi, just want some opinions on this. Doing some lessons today on a ER6 and my instructor said I should of stopped to let this guy cross the road. I said to him that the guy stopped so I didn't need to, but the instructor said he didn't let me go he was forced to stop because I was turning right. My instructor said every piece of road is a pedestrian crossing :s

Basically just watch the video and let me know if you think im wrong when turning right while the guy is waiting to cross. Cheers.

You're right.

He hadn't started to cross. If he had already started to cross, he'd have priority, and you would have had to give way.

Yea if i see someone crossing i would stop, but my instructor said i should of stopped and treated it like i would of if there was a oncoming car. He said the guy stepped off the road and started to cross but he had to stop because i was turning. Apparently i would of failed my mod 2 for that according to my instructor.

Its a bit iffy in your video because it shows that the ped stops at the side of the road (I'm guessing because he saw you indicating to turn in there) but from a following instructors point of view it could have looked as if he took a step backwards out of the road.

Personally I think you are fine but I can see why your instructor flagged it up as the guy with the dog would have had priority if he had started to cross properly.

He stopped because you were turning; you turned because he stopped. Seems fine to me.

If he had already stepped into the road and was crossing when you arrived then he would have priority and you've have had to give way.

If anything, it felt like you approached and turned rather quickly, considering there was a man with a dog waiting to cross but you're not required to stop for him while he's still on the pavement as it's not a crossing.

In the UK pedestrians Rule the Highway.

No matter what. If you hit one expect to share most of the blame.

Famous true story.
A Dr. and his family were driving along the M8, just as it crosses the River Clyde in Glasgow City. At the time there was a flower festival Rolling Eyes on in Glasgow.
A group of pedestrians decided it would be easier to walk across the M/way rather than around the roads.
The driver ploughed into them as they started crossing the road. Some cnut was kaputted.

In his defence he said he blasted the horn when he spotted them.
Judge ruled, he was to blame as if he had time to sound his horn then he should have been able to stop.

Makes sense as the rule is to not drive faster then you can stop safely.

Not many case where the driver gets off with it in town.
The person would have to spring out into traffic.

In your circumstance your instructor was correct. An examiner would fail you just on that. Courtesy for other road users.

It's no' a race your in son. Smile

Suck it up. Move on.

The dog wasn't for stopping "Fuck you motorcyclist guy Middle Finger ." but the human was a chicken.

I would not had said anything about that.

Recommended action: Plonk two Loperamide in Mr. Driving Instructor's coffee before yous go out next time. Maybe he won't shit him sel' then.

I hate those cnuts.
I used to try to T-bone the fuckers (in the works van). Get photos etc. Look your honour, I'm on my side of the road. Smile

I also got told that at 50mph i should be in 6th gear. I was in 3-4 gear at 50mph and he was wondering why i wasnt changing down, he said its because im in too low of a gear for 50mph :s. He then said on my 125 i should be in 5th gear when im doing 30mph, i said no im in 3-4 gear and he said thats too low.

I think its pointless being in 6th gear on a 600cc while only doing 50mph. The revs were only at 4k out of 13k and he said i shouldnt have the bike screaming so change up :s.

I prefer cruising in 6 Revs are about 2k.

The 1300 can plod at that from 25mph in 6.

When I sat the test the y were looking for 3-4 around town but for the Nat. limit roads top gear. 50 in top is fine.

You won't fail for that. I went all round Salisbury city centre on my MOD 2 in 1st. It was loud, fuel inefficient and probably not good for the bike........ not my bike zero shits given.

Examiner mumbled some crap at the end about needing to be more environmentally friendly.

Maybe he could have been a hazard and you could have stopped to make sure he didn't cross.
Looked like you saw him and went straight away without having sufficient time to make a proper judgement.Not saying that's what you did but just what it might have looked like.
Tough one really but I guess stopping and making sure he wasn't a noddy would be the thing to do if this was on a test.

More likely if you were in test environment and you had have stopped, you'd have been marked up for undue hesitancy. It's just one of those annoying things that happen where it's a should I shouldn't I, and it's half a second in the difference between it being the right and wrong answer.

Funnily enough on my mod 2, about two mins after leaving the test centre I had to turn right into a side road, que dozy bird walking along the pavement playing on her phone, I was committed to the turn at this point she steps straight onto the road without looking. Luckily she then heard the bikes and jumped back up out of the way. I didn't fail but myself and the examiner had a bit of a discussion about what I could/should have done different.

I'm assuming that you had started to indicate in good time, because on a lesson.

Dog walking guy was well aware that you were intending to turn into the road and stopped.

Dog walking guy knows the green cross code.

You should punch your instructor.

Ped makes an abrupt stop before entering the road, which you correctly interpreted as him stopping to let you pass. You passed. There was no conflict and I see no problem.

If the ped had started to cross before you entered the junction, it would be a completely different story, and you'd be one of the many uninformed people who believe they have right of way when turning in to a junction, when they do not.

Your instructor could make the argument that the dog was in the road (which it is) even though the ped wasn't. The ped is also a child. So you've got a vulnerable road user (child) and a potentially unpredictable pet (dog), one of which is in the road, the other is near it. I can understand why he may have held back himself in that moment, or perhaps why he thought an inexperienced rider should have. I can see the argument from both sides, so I attribute blame nowhere.

It's not something to change instructor over, it's just one of those things.

Hard (if not impossible) to say whether an examiner would or wouldn't make the same call as your instructor... some might, some might not and infact go the other way and penalise you if you'd stopped to give way.

The trouble is the instructors and examiners can't tell what you've seen and you're thinking and prepared for... you could be ready to take save and suitable avoiding action if the stationary pedestrian on the pavement suddenly steps out on you, or you could have not even seen them and be focussed only on riding with no situational awareness... the outcomes might be very different but from an outsiders point of view the riding may appear the same until the defining moment.


In the road, in the right. They weren't, you were fine.

From the video I would have turned into the road and told my student to also. It's safer to turn than it would have been to sit at the junction and wait for the pedestrian to cross. If the pedestrian had already started to cross you would have been wrong but in the video he saw you and stopped before his foot left the kerb.

My instructor was a nice enough chap, but I'd been car driving for 20 years before starting on the bike - which he knew - and he still kept yapping to me about general roadcraft, even though he admitted when we spoke about it that he needn't. He continued to do it even after that conversation, so I just sucked it up as it was just a means to passing.

I suspect they probably get into a routine and have to make sure they teach people to some idea of a highest standard, even if we disagree with it with experience.
