Hi guys

Gone around to see a bike I was looking forward to buy. There was some damage to the bike but hpi report and owner says it's not declared to the insurance . Anyways , he had the v5c/2 filled in his name and claimed that new one hadn't come and it's been 5 weeks .... I didn't have enough cash for the sale and we agreed for a rough future date.

I got the money earlier and asked him if he's available . He told me he'd sent the v5c/2 off for a full v5 and it'll take 4 weeks to come !

Now The hpi report shows the current v5 is dated for start of July .... I'm assuming he has / had it and lost it or isn't wanting to show for some reason.

Is it possible to legally own the bike without the v5 or the v5c/2 and can I buy it with confidence / should I buy it . He is selling it so soon due to a shoulder operation. As for the bike, my mechanic checked it and all seems mechanically fine .... And the guy seems legitimate

V5 explicitly spells out that it is not any proof of ownership.

It is only proof of the 'Registered Keeper' NOT THE OWNER.

It is difficult to prove who owns it using government documents.

You should also ask for a Bill of Sale as this can be considered some indication of ownership.

I would not put much money in a vehicle without the V5.
It should have the record of the number of former keepers too.

Not sure exactly what the Taffies have done to fuck up the old registration procedure but what ever they have done most people find the new system more alien.
It is supposed to be more Streamlined/Fast-track Rolling Eyes (Really just a money spinner and a way to lay off a few hundred Civils)

Wait for him to get V5 or find another bike. Not worth the headache otherwise.

The DVLA might say V5 is no proof of ownership bla bla bla but it's a pretty good indicator of who owns it and plus you need it to tax the bike.

"DVLA recommends buyers ask to see proof of ownership of a vehicle - such as a bill of sale - and check the vehicle’s service records and a MOT certificate to assure themselves that the sale is legal.

Criminals try to legitimise the sale of a stolen or cloned vehicle with a forged or stolen registration certificate and they get away with it because many motorists believe that a V5C registration certificate is proof of ownership. It is important that motorists are aware that this is not the case."

I only stated that bit about the V5 as one must think of the rare exception when some pikey fucker stuffs you.

The V5 won't stop the courts or The Man removing the beast from your place of keeping if they can prove otherwise.

It is not common but it is regular enough to be a significant concern.

People get skunked on Bumtree/E-ghey everyday for stuff.

Hmmm....

I guess ill wait for the v5. Even then, ill get a bill of sale stating that the seller has full right to sell the bike to myself

That's if he still wants to sell it.

At the moment, He's saying 'i guess ill just get work done and sell it later on' which might just be to entice me to buy it without the documents

I ment more that them not having the V5 is a strong indicator that something is dodgy. I would not buy without it.

Oh, what a tangled web. Yup, VED is the kicker, but the good news is that until the DVLA change the keeper to you (and send you a V5C) then who are they going to blackmail?

Is it a genuine bargain? Did you do the HPI check on the frame number? Did the details from it match the bike?

If so I wouldn't dismiss it completely out of hand.

It's a 2009 k8 bandit 650
Details match . As for the damage, the tank has a handlebar caused dent and the infill panel around clock is broken on RH side ( the fairings were replaced ) MOT shows the handlebars are slightly bent as an advisory - asides that , mechanically the bike is sound . The price we agreed upon is £1600 so I'm not sure if it's a great bargain ....

Ps. It's got 21k on clock and part service history
