We don't see what'd happened before.

Lorry driver shouting at cyclist next to him and intentionally (we are led to believe) trying to 'block' him and put him in danger could see charges leveled I would expect.

Cyclist still a tit - if bad things happened, lorry driver would get out of prison, cyclist wouldn't get out of the grave.
