Mine was nicked. I picked up free because law states it. People need to push more.

Also, I can't take anyone with a car as their avatar on a bike forum seriously.

Haven't we done this before? The case law predates amendments to the legislation which clarify it in the favour of the victim... it does need testing in court though Smile

Which, thinking about it, makes that petition even more utterly pointless than most of them as the legislation has already been sorted, it just needs to be accepted by the people taking the vehicles.

It might do for the fraction of cases, but not the massive majority; "recovery and storage" is legislated, I've been charged myself as a victim.

Dude if an avatar is the deciding vote for you on an issue like that, you have problems Laughing half the forum drive, do you have the same response to animals and people in avatars? Wink

How exactly do they gain traction without a few thousand sparing 30 seconds to start with?

Maybe such views are part of the problem?

Do these petitions achieve anything? When they 'debate' them in Parliament it seems to be a 10 second passing reference, in which they give some bull$hit answer before swiftly moving on.

But the legislation says the thief must pay, not the victim. The only thing that says the victim should pay is the case law 'borg points to, which is now outdated..

I was had by this myself almost a year ago, still can't sit down without wincing Sad Everyone except the victims of vehicle theft is happy with the status quo though. I mean, who else would pay for it? They'd have to catch the thief to start with. What a jape. Better to petition for the police to actually ask the owner if they want their vehicle recovering for £150 or leaving where it is, might possibly get somewhere with that.

The massive majority of thiefs are never caught, so cannot be charged?
Yet the owner/registered keeper has to show up and collect, so it's no a brainer.

Well, I signed it, because sitting with the opinion that a national rag hasn't pushed with it, so it's not my time is what screws us over constantly.

Section 8. If the owner doesn't know it was left somewhere where the vehicle is in the way and needs to be removed, they are not responsible.

My bike (and most stolen vehicles, as I understand it) was recovered under Section 99, Section 100 deals with the fees for this practice. It says Sections 101 or 102 can be used, except if you actually look at the legislation Section 101 is for vehicles that should never see the road again, has no tax (licence?), has no number plate or the owner cannot be found. It's right there in (3). None of these are usually the case for stolen vehicles, we're all being had.

No one I spoke to at the police or through FOI requests could answer why this was, we only found out about the pertinent piece of case law from someone who asked the Met. Except it's out of date now.. All I ever got from Leicestershire police was "but who else would pay??". Ha, thanks guys! It's a no brainer if you can't read or look stuff up for sure.
