I cancelled my first insurance policy ever due to sale of vehicle.
When I called up about a week ago they emailed me all documents and made no mention of anything else.
Yesterday I get this email from them...

Quote:
If you have already returned a declaration to us within the last 7 days, you may ignore this email.

As you opted to receive your policy documentation electronically, we will need you to reply to this email within 7 days to confirm that your policy has been cancelled from 11th August 2016.

Section 147 of the Road Traffic Act 1988 (as amended by The Motor Vehicles (Electronic Communication of Certificates of Insurance) Order 2010)

Your policy has been cancelled. It will be deleted from the Motor
Insurers' Database which is used by the police to enforce the law on insurance.
If you use your vehicle without a valid policy, you will be committing an offence.

This declaration must be submitted to the insurer or the insurer's appointed
agent within seven days of the cancellation date. Failure to comply with this
requirement is an offence under Section 147 of the Road Traffic Act 1988.


That email was also sent 10am on the last day of their "must be submitted to the insurer or the insurer's appointed
agent within seven days of the cancellation date"

Stupid question so in the Noob section, but since it's all digital I don't have to do the ridiculous and attach the PDF certificate to resend to them do I? (I know you have to return paper copies ofc)
Can I just reply with "Yes I cancelled my policy"?
The email seems rather vague about what to reply with
I'm not entirely sure what they're threatening the consequences are either tbh. Thinking


Whilst I'm at it, is it not standard practice to refund something for 3 months unused paid for insurance?
The dude on the phone just dodged my question when I queried it.

(a) transmit to the insurer, by means of an electronic communication to an electronic address specified by the insurer, a statement confirming that the policy to which the certificate relates has ceased to have effect

(5) A person who fails to comply with subsection [4D] above is guilty of an offence.


tl;dr version - what Ste said. However, you must send it to "an electronic address specified by the insurer".

I'd be astonished if anyone has been charged, prosecuted and convicted of this "offence", ever. If you're willing to take the real risk of actually riding a motorcycle, laughing this off shouldn't keep you awake.

Ahh so it's more an offense so you can't just ignore them for all time without being penalised?
Makes sense, the email was sent from the "CancellationsAdmin" address and it said "reply to this email So I guess im safe with following Stes advise (first time for everything) Shifty

From what I can google it seems the punishment is at worst a fine?
If so I'm not overly concerned.

Another life lesson of the bullshit intricacies of Insurance. (It seems all the stupid identity verification over the phone didn't prove I called to cancel) Rolling Eyes

Not to the very specific extent required by the statute.

However, it's got absolutely nothing to do with the insurer - they're not committing any offence, and have no duty to inform or remind you or to police it.

When there were only paper certificates, there was a sort of point to requiring their return. In the electronic age, with the PNC, MID, recorded calls and identity checks, it's a farcical law and should be treated with the utter contempt that it deserves.
