She says she never wants to drive again. So they ban her. Well, woopie.

Grammatical and spelling errors in that article were horrendous.

"she doesn't wear makeup"

Top class. Top cocking class. Who the fuck lets reporting like this go unchallenged? It's almost as if it's designed to make people focus on the errors and stupid reporting rather than the fact some divot bint killed another human by being a twat. Don't get me wrong, I'm mad about that, and the lenient sentence, but if the family of that guy were to read this they'd lose even more of their shit.

Sick

I was at Manchester Crown Court in Feb this year as a witness for the prosecution, saw a biker killed by a woman doing a u-turn on Amounderness Way in Fleetwood , 11th April 2014, she got 18mths suspended and a 3 year ban , his family lost a dad to 3 kids and a husband, terribly sad

Oops, that just slipped out!

You kill someone, it should be a lifetime ban, no exceptions. Not as punishment, just as common bleedin' sense. If you fail it that badly, you don't deserve a second chance.

I don't know if it's just the defence, but I this is the first article like this I have read where I sense the woman is genuinely remorseful at the fact that she has done this and acknowledges it is devastating to their victims and their families.

I think I agree with the judge - a longer sentence would not benefit anyone.

the logic is so flawed, if you ever get caught speeding.. run the officer over till he is dead.

12 month ban

winner!

That sucks for all his family and friends but I can't think of any other punishment that would fit in with modern society and being moral, a lifetime ban from driving should be standard. Also sucks a lot for the ones who watched their friends/husbands die and got injured themselves, some of the physical pain from injuries never goes away and causes problems in every day life for the rest of their life.

This kind of accident is pretty scary because it's out of your control.

It's one thing to be prepared for car drivers not seeing you in their mirror, coming out of a junction, when you just happen to occupy a space on the road that they want etc etc. but what can you do when someone just turns across the road in front of you?

At some point you have to assume that car drivers are at least vaguely aware of the world around them, else you'd be crawling along at 20mph in terror of these mad psychotics in metal cages trying to mow you down. Based on what I have read in the article it sounds like by the time she turned he was so close he had no time to react. What on earth can you do that situation?

Oh and why is it not a lifetime ban?! If someone dies because you aren't capable of driving safely, why will that be different the next time you get in the car? It's not a matter of punishment (I expect the guilt will do that), it's a matter of other road users safety.

A lifetime ban given to this woman would be honoured by her. Most people who cause accidents like that, hit and run etc. will go on driving anyway and Middle Finger you.

OK, it's a SMIDSY. If she had been on her phone at the time I'd agree with a long sentence like that female copper DIDN'T get. If she had been drunk I'd want to throw her in the cell with the dead riders family and let them work things out.

In this case I just feel it's tragic for everyone involved.

I agree that at the end of the day this is just a terrible accident but even then I feel the punishment is inadequate. Not so much prison but the fact a family has lost a father and maybe the main provider. A lift time ban and a fine or something through her insurance to provide the family and children the money for growing up/university would be suitable.

If they get tugged then the suspended sentence kicks in and they do actual time inside.

Every little helps.

Can someone help me understand the punishment?

Is it;

12 months from now, let's say 20th May 2017, she can just get in a car again?
or
12 months from now she has to re pass a driving test before being allowed to drive?

I, like others, feel she is truly remorseful. I find it commendable she wasn't saying, "he came out of nowhere, he was doing a wheelie going far too fast", as her defence.

I also agree with the defence stating she did not want to talk about her anguish because that would be a plea for sympathy.

She obviously fell far below the expected standard of driving. She should ONLY be allowed to drive after passing an extended driving test, and perhaps for those who have killed while driving, they should be made to pay for a retest every x years (I'd suggest between 2 and 5).

Maybe I'm just in a bad mood this morning, but I think the punishment is way too light. So she feels really bad about it, no point in locking her up etc. True, but she killed a guy cos she had her head up her arse.
A lot of people take driving a vehicle for granted and most of the time they're not really concentrating.
Yeah, we all have lapses of concentration, but how many bikers pull across the front of cars without looking?

Why is that? Fucking consequences. Driving a car? Meh. No biggy.

In the same way that celebrities don't like to talk about how much charity work that they do, at every opportunity.

That's coming from her defence brief, who lies for a living. And everyone blubs in the dock, it doesn't mean that they're shedding a tear for someone else.

What astonishes and enrages me is the prosecution making the case for leniency by talking about her admission at the scene, and how upsetting all this was for her. That's not their bloody job.

I commend her guilty plea to the extent that it's commendable, but I don't believe a word of the rest of it, just on general principle. It's not contestable evidence, it's just a bunch of words.

I agree to an extent, but the whole defence was a bit 'woe is me' - why bring her husband and young son to the scene of a fatality, even if she was cuckoo following the accident, the husband should have known better than to let a child see that unecessarily. The whole 'oh I've been distraught and dont wear makeup anymore' - boohoo, you'll get over it with time and counselling; you can't get over being dead.

You can get banned for a year for all sorts of relatively minor infractions. 5 year bans and jail terms are commonplace for deaths. She's effectively been let off scott free.

Fair point. The prossy-cution should be going for blood, the defendant defends those charges. Perhaps I was being naïve by thinking those words came straight from the woman's mouth and not induced by the legal eagles.

She'll have to re-apply for her licence at the very least:
https://www.drivingban.co.uk/drivingban/banneddriving.htm wrote:
How do I get my licence back after a ban?
For bans of less than 56 days, the DVLA should return the licence to you automatically when the ban has expired. If you do not receive the licence, contact the DVLA direct.
If the disqualification is for more than 56 days, your licence will automatically be revoked. As a result, you have to formally apply for a new licence, which requires making an application and paying a fee. If you fail to make a formal application, the licence will still be invalid, regardless of the fact that the disqualification has been served.

Article doesn't mention a re-test, although pleading guilty to death by careless driving surely means she'll have to take one?

I agree that it's tragic, but your post implies that a SMIDSY is acceptable as an excuse or something that just happens.
In this instance SMIDSY = Sorry mate I didn't look, so now you're dead.

I'm glad she was convicted for death by dangerous driving. I imagine if she had said that the sun was in her eyes she would not have been prosecuted at all.

I think a big part of the sentencing is intention.

If you happen to be a dopey git and dont notice a bike at a junction and SMIDSY him/her then you had no intention to cause harm or break the law however life has been lost at your negligence. As such you are sentenced in such a way that benefits society, there is no point in locking you up and throwing away the key at the expense of the tax payer when you can be out working, paying tax, provided it is in an enviroment where you are unlikely to commit further negligence.

However if you are caught doing 120mph you also do not intend to cause harm however it is really difficult to argue that you where not INTENDING to break the law, and as such you require 'rehabilitation'. That rehabilitation normally comes in the form of a hefty prison sentence because you have shown disregard of the law.

Thats the way the legal system tends to look at it anywho, in the UK we operate a rehabilitation based system of law rather than the punishment ones used elsewhere.

You're part way there, but it doesnt work. Being banged up doesnt really make you less likely to want to go fast again in future IMHO, it just ruins your career/relationship.
