I'm looking at a bike for sale today, first regged in May 2014 but the vehicle enquiry service shows the MOT as just being expired by a few days.

The bike is a cat D, so would this affect the MOT period, or does the clock start running when the bike is imported or something like that? I was under the impression that it would have a 3 year period before requiring MOTs Thinking

First MOT requirement is on the third anniversary of the date of first registration, however, if an insurance company stipulated that it had an MOT after being written off, that could reset the clock.

Edit: Or maybe the PO had it done, as proof that it was roadworthy after repairs.

Category D, insurance write off, so to ensure it is safe for the road it has to have an MOT!

No, there is not and never has been, any legal requirement to have an MOT after a write off, neither for cars or bikes.

Some, but not all, insurance companies ask for it to be done, but that's al there is.

This is what VOSA said back in 2012

Quote:
Taken that into account to return a written off motorcycle to the road requires only that the vehicle be repaired to a road worthy standard.

Some insurance providers require a new MOT be conducted but this is purely their own company policy and not national law any pre-existing MOT remains valid regardless of a write off.

Seller says he did the MOT after the cat D, but MOT centre said no MOT required until May 2017 Thinking

I need to sort insurance anyway, so will let them know and it's up to them to figure it out I suppose?

MOT is a year's 'ticket' and expires hence what you're seeing on the system.

no idea if legally it needs to have one now that it's had one that's expired as, techncially, the legislation is 3 years from the date of registration.

if you phone the DVLA and ask two different people you'll get six answers, bonus points if one answer involves donkeys

So, read the Statute.

https://www.legislation.gov.uk/ukpga/1988/52/section/47

"the motor vehicles to which this section applies [requiring them to have a test certificate issued within the past 12 months] are those first registered under the Vehicle Excise and Registration Act 1994 or any corresponding earlier legislation, not less than three years before [the date they're being used on the road]"

In English: no requirement to have an MOT until 3 years after first registration. Voluntarily doing one earlier has no bearing on that.

Friend Computer, DVLA and Dibble may disagree, but I'd be confident of seeing them off if push came to shove.
