Hi guys, not sure if you can help.

My son passed his cbt last week and we helped pay for his scooter (which was a fun ride home for me lol) any his mum paid the deposit for the insurance and he was planning on paying the 8 payments of £35.

Well today I get an email to say they are cancelling the insurance as they cannot get a credit agreement? And that the will be charging him cancellation charges and fees as per the agreement.

Can they do This? Surly if they can't get the agreement, they can't charge the fees as there is no binding contract? The basicly want full payment, which we cannot afford as its over £350 which is why we asked for instalments.

I would hope not. Surely if they are to provide a service to you and then don't then you should have grounds to get a full refund? Sure nothing extra going on here? As for affording it, maybe get one of those interest free on all purchases for a year type credit cards if you can and put it on that? He then makes his 35 quid a month payment to that.

Tell them that you are not cancelling the insurance and that you are willing to pay the installments as agreed.

If they choose to cancel it for their own reasons, then a cancellation fee is not due.

I don't think you understand how paying monthly by instalments works. If the credit company have assessed him to be too high risk, then there's nobody to pay the payments too. I am guessing if you read the paperwork, there will be a "subject to credit" or similar.

Other thing to worry about is "have you ever had your policy cancelled"?

I'd have thought it was state 'subject to credit agreement' somewhere. Which would mean no insurance to cancel if no credit agreement in place.

got to agree i dont think they can charge YOU if they are cancelling it.

Why not just pay the installments yourself and ask him for the money, problem solved.

most likely your son has no credit history..ergo computer says no.

Isn't there a time limit where any contract you agree to can be cancelled without penalty?

Or https://www.citizensadvice.org.uk/ who now do the work of Trading Standards.

They are very good for giving you the correct for of words in all further proceedings.

I think the Misrepresentation act 1967 will be your friend here.
