 |
|
The tax for one of my bikes runs out at the end of the month.
The insurance runs out tomorrow.
I'm pretty much decided on selling it anyway so I'm not re-insuring it.
I've just been online to declare SORN. It registers the "SORN start date" as the 1st of November. No option to change it. The SORN start date needs to be tomorrow (20th of October) or I'll be guilty (again) of being in posession of an uninsured vehicle.
Written declaration has been duly posted. ____________________ “Rule one: Always stick around for one more drink. That's when things happen. That's when you find out everything you want to know.”

Sadly, my understanding is that despite the sterling efforts of sickpup et al, that the DLVA kept trying and trying until they got a win in the High Court which took a dump on the Interpretations Act, and we[1] now require proof of delivery[2].
However, if you do it online, you should get an email confirmation that will confirm (in its headers) that you delivered the required declaration today.
With that to hand, I'd be answering any blackmail demands with a reference to Arkell v. Pressdram.

[2] Sod me if I can find the reference to it though. Best of luck. ____________________ Biking is 1/20th as dangerous as horse riding.

So is this an actual prosecutable 'thing' then?
I have temp insurance on my car which runs out 3 days (max was 3 weeks) before my main policy is renewed and this car is going to move onto that. It's going to cost admin fees and such to move it over 3 days before renewal so that's not particularly desirable. Plan of action is to leave it parked on my private driveway for 3 days and use the R1 (any excuse aye).
I'd find it incredibly disgusting/abhorrent if I'm expected to sorn and re-tax my car mid month 3 days apart, having to pay the tax twice for that month?
Someone please tell me it's just threats and b-s? I know I've had a bike taxed and not insured for a week or so recently (few months ago) but nothing ever came of that |

Prosecutable, sure. The instant you have a vehicle that's not insured, you're technically committing an offence unless it's also SORNed.
My experience was that there's a clear month before the DVLA sends the first blackmail demand, and that if you SORN it then, they lose interest.
Bear in mind that they don't get any money out of a successful prosecution, so they're only going to carry out a few of them for form's sake. ____________________ Biking is 1/20th as dangerous as horse riding.

They probably wouldn't prosecute for it (or demand a £100 out of court settlement) but they COULD. And I have previous.
The point is more that their online system for declaring SORN is defective and could leave me liable for prosecution, even if that is unlikely to actually happen. It certainly leaves me comitting an offence (section 140, Road Traffic Act 1988).
Being the registered keeper of an uninsured vehicle is illegal unless you have made a declaration stating it will be kept off the road.
I should point out I have also reported the issue to the DVLA beta testing department on the basis that they are the ones who can do something about it. ____________________ “Rule one: Always stick around for one more drink. I Sorned two bikes, online, in January.
I've just checked the confirmation emails they sent back, and they're both dated the 28/01/16, so no end of month scenario going on then! ____________________ "Everybody needs money, that's why they call it money!" |

I'll be interested to see what happens with one of my vehicles......
I recently moved, although not recently enough, and genuinely thought my insurance ran out sometime this month; turns out it expired in August and the renewal was sent to my old address.
I haven't used it on the road, so I won't have been ANPR'd, but neither have I reregistered it, however, they have still been collecting my monthly VED DD, whilst it was technically a legal impossibility to tax the vehicle.
I'm just trying to decide what order will confuse the system more, insure then reregister, or the other way around. ____________________ Things get better with age; I'm close to being magnificent........
