Hello I am in need of some advice please.

Beginning of September 2012 I was riding my moped to work and was stationary on a side road waiting to turn right.
The driver did not see me and accelerated fast across the road and hit my bike sending me hard to the floor and nearly knocking me out, I was dazed and couldn't get my body to respond to get myself up

A kind man helped me up and also the guy who hit me came over saying "Are you OK? I am sorry i didn't see you the sun was in my eyes and i could not see you in the middle of the road".

Ambulance and police came and gave me a check over and took statements and after about an hour i got on my bike (Bike was OK just external damage) and went home with a severe headache and rang work to say i will not be in as i have been knocked of my bike.

The next day i woke up in bad pain with my neck and right leg and lower back and a insane headache.

I phoned insurance and they passed my case to Minster Law Solicitors.

I had a letter confirming that liability from the driver has been admitted and also i had a engineer come and see my bike and valued the damage repair cost at £800 which will be recovered via compensation.

I had 2 medical assessments as I was still in pain after the first one.

I had my 2nd medical assessment a month ago and now have a letter from Minster Law with the valuation based on my medical report and to put an offer to the other side which I have accepted.

They are going to put a part 36 offer to the other side.

My question is how long does a part 36 offer take and when should I expect settlement. The guy who hit me admitted liability.

I know that the above question I'm asking will not have a definite answer as everybody's case is different.

Minster Law have helped me on 2 claims (Bennetts?) and have been very good, reason I choose to insure with them if they offer a reasonable price.

Same position you are in I had on both occasions, from start to finish 5 months and 6 months. They get it done and are very helpful IMO.

I find to keep chasing and asking what's happening helps, although when you send across a offer, they get 3 weeks to respond, if they send a counter offer, then you send another back, that's another 3 weeks etc.

Wish these things were quicker but they do take a while, alot of peoples claims go on for years.

Hiya thanks for the reply, yes I was with Bennetts. So it is possible that my claim would be settled before the end of this year?

Well as the offer has gone over, if they accept, say 3 weeks then job done.

As above, if they start doing counter offers etc could go on a while. Could be a lot of to and forth. I had it on one of my claims they didn't want to pay full money for my helmet, obviously I wasn't happy so they went across again which took longer than it should as they paid full in the end.

I cant speak for this particular company but Im just about to finish a personal injury claim myself with Bollin and Legal.

In December myself (passenger) and my friend (driver) were rear end shunted when we allowed a refuse lorry to pass in the wet.

We started the claim about January and Friday my friend received a cheque for £2,000 and Im expecting a cheque for £3,100 any day now.

I had to delay my medical as I told them that it was unreasonable to give work less than a weeks notice to book a day off, and then once they recieved the medical reports they have to allow the other party a "reasonable" amount of time to respond. If they dont respond within this reasonable amount of time they then file for court and thats when the other party makes an out of court settlement.

Well, thats what happened with me.

You can use any claims management outfit that you like. It's got nothing to do with your insurer. You might end up using them against your own insurer if you're fully comp.
