I mate at work IM'd me this...

Him:
Told you about that CBR outside didn't I?
Me:
?
your one or *another CBR owner at work's*?
Him:
the black 600 out in the motorcycle bay
in ***** St, you can see it from your window
Me:
what about it?
yeah I just looked
Him:
I'm now the registered keeper
Me:
do you mean you bought it?
Him:
No, I mean I applied for the V5 because it's not been moved in 9 months and now it's registered to me
HPI checked it and it's all clean
Me:
random
It doesn't mean you own it
Him:
correct
but you know what does say who owns it?
nothing
it's weird
Me:
eh?
Him:
there's no official database to say who owns a vehicle
Me:
so why have you done this?
Him:
Figured it was abandoned, it's a nice bike
Me:
right but you can't do anythign with it
Him:
applied for contact details of the owner and that was rejected, but they approved the v5
Me:
and now you are legally in charge of it
Is it taxed/mot'd/insured?
Him:
yep
all of the above
Me:
so when that runs out
and it's parked on the road
you are responisble for the fines
but if you move it that would be theft
Him:
well the plan is to move it off the road before then
it's not theft if I'm the registered keeper
I think
Me:
I can't help but fell you have just opened yourself up to a world of pain
Him:
it's a very grey area right now
Me:
it is theft
you don't own it
Him:
who does own it?
Me:
the owner
Him:
if you abandon something, do you still own it?
Me:
I can see this ending a number of ways
Him:
well herein lies the quandry
Me:
none of them involve you holding on to a free bike
Him:
the v5 does have the previous owner
Me:
define abandon
Him:
and I've done some digging and the person appears to still be alive
and in theory still works down the road
Me:
maybe it broke and the bloke knows it is there but is saving the money to get it fixed
what do you know about them?
Him:
they live in a big house in *****, his dad owns a consultancy firm
he works for that firm also
he has a younger brother
he's on facebook, I am not
he's on linkedin also
Me:
What are you gonna do
Him:
I don't really know
Me:
hi I've taken ownership of your bike
I hope that's OK
Him:
never thought it would get this far tbh
Him:
"you're not looking after your bike, I'm taking it off you"
hah

I agree with you Chris-red. I hope your entitled work pal doesn't get to keep the bike! Razz

I don't get why someone can see something and think "i'm having that".

The "big house" statement seems like he thinks it's ok to take it off him because he appears to have money.

I'd strip for parts and then sign the V5 to a random Polish name for export.

I'm not 100% sure if this is still the case, but under these circumstances the DVLA used to write to the previous RK to let them know that the registered keeper had been changed.

If that's the case, expect some excrement to hit the fan shortly ...

Fixed that for you.

Next step, your mate will be receiving a 'keeping an unlicensed vehicle' letter.

DVLA will have written to the previous keeper and not got a response.

Legally, he's stealing it. He's about to lie to an insurer about being the owner of it.

Morally, why not? They're not using it, they demonstrably don't care. He's made himself responsible for it.

When the owner comes back from his year long posting helping orphaned kittens in Elbonia, he can whip out his proof of ownership (we do all insist on receipts, right?) and get the bike back, including any money that Matey has spent on it.

I may have some pikey in my ancestry, but I'm finding it hard to get outraged about the idea of a bike being ridden rather than abandoned.

I know, #WhatIfItWasYours, but I don't leave mine out taking up a parking space for 9 months.

Yup that's the badger. Its now on a public road - untaxed - and in your mates name....

Not only that, the previous Owner has not only lost the remainder of his tax that he paid for... Hes also been sent a letter telling him the name and address of the person that caused it! (Nonsense please ignore)

Smile

Exciting times ahead for your mate.

Laughing

This can only end badly IMO.

A mate of mine used to live in an apartment in the city centre and had nowhere to park his car, so he used to leave it in the works car park. Looked like it never moved, but he walked to work and fetched it at the weekends when he needed it, and no one was really looking. Could something similar be the case?

Really? I consider myself told then - I assumed the "Your vehicle has now been registered to someone else" letter advised of the new keepers details.

I retract my statement.

Thumbs Up

No, that's right, it just says that someone else has applied for and been granted a log book. It doesn't say who.

Well, claiming other peoples bikes is not and never will be a thing. The closest you'll get is finding the owner by contacting the DVLA and offering them some money for it.

he should contact the prev owner (considering he know who they are and where they live/work) and make an offer. To move it would be theft, end of.

otherwise it really won't work out well for him

Who's to say that the former registered keeper was also the bike's owner?

Maybe it's the worlds longest police stakeout to catch little billy-bob when he attempts to break the steering lock and wheel the thing away.

Bloody incisive point.

Possession may be 9/10ths of the law, but keepership is 9/10ths of possession.

Actually, since there's no register of owners, Matey could (if he was a rogue) use the yeah-bought-it-off-a-bloke-legit gambit and turn it into a civil wrangle.

Pass the popcorn indeed.
