So I live in a ground floor flat, and the people above us were having there windows cleaned.

The bastard decided to help himslef into our back garden (side gate is broke and haven't got round to fixing it) and scared the crap out of my daughter.

Unfortunately I'm at work so couldn't do anything there and then, and my other half was half asleep because she works nights shifts.

I'm trying to find out who it was so i can phone him and tell him next time he enters without permission I'll get the police involved and press charges.

I don't mind if he needs to go round back to do his job and I get on well with the family above, bit it's more the principle of him bringing it upon himself to get through (he must have squeezed because there is an extension making the gap narrow with a bush at the end, and the gate doesn't open fully).

Any way, rant over, tl;dr window cleaner is a bastard.

I fear you've been watching too many Septic procedurals. You do not press charges. In most cases, the police don't either. That's a decision for the CPS (or Fiscal).

They won't do so since (temporary) trespass to land is a civil tort in Englandshire, not a criminal offence.

Feel free to bring a civil case against him. What would your losses be? What remedy would you ask for?

Neighbour should have warned you it was gong to happen imo. He was just doing the job he was hired to do.
How else was he supposed to get to them without abseiling/hanging platform?

I'd check your deeds before you kick up shit, the owners of the flat above probably have what's called an "easment" which gives them access to your garden to carry out routine maintainance to their property.

As Roger says, Trespass is not a criminal offence in England (and doesn't exist at all in Scotland), you can't be prosecuted or arrested for it. You could sue a trespasser for damages but you'd have to show actual losses were sustained as a result of their actions.

Also, to be guilty of trespass, you have to have been asked to leave and refused to do so. In such a case, a landowner is then allowed to use reasonable force to remove the trespasser from their property.

Personally, I think you're being unreasonable. How the hell else is your neighbour supposed to clean his windows? If you speak nicely to the guy, he might do yours too for much cheapness since he's already there.

In what way? Admittedly I was angry, probably thinking a bit irrationally and won't actually do anything about it.

However I'm still going to speak to the neighbour, it's more of the point we weren't expecting anyone to be there and had my daughter phone me because there was a man in the back garden, so probably a bit of paternal instinct kicking in there as well.

I hadn't really bothered because in my area you could leave the front door open and be fine, plus it takes a lot of effort to get through as it is, so kudos to him for commitment.

I would be extremely "unreasonable" if I found someone wandering around my garden.

He can knock and ask but just going in there is bang out of order in my world.

Even with an easement, people are supposed to give you notice, not just turn up and look in through your windows. Without an easement, if you deny permission, they have to go to court each time they want access.

.....then again, I like my personal space so may be more grumpy than most on this type of thing

So your daughter is essentially home alone? If she's old enough to be left on her own, then she should be old enough to identify a man in the garden, with a ladder who is cleaning windows as a window cleaner. If she gets frightened by that then she shouldn't be on her own.

Presumably the window cleaner will be cleaning your neighbours windows again in the future. Just ask your neighbour when they're due to do it, then tell your daughter. Window cleaners will have a routine, 3rd Wednesday of the month type thing.

I'm in agreement with this. Ask before entry.

If he wandered into my rear garden he would be met with 45kg of German Shepherd wondering why he was there. If he wandered in while my grand daughter was in the garden he would have been met by 45kg of German Shepherd intent on chewing on his goolies.

Load of people, otherwise there'd be no call for window cleaners

I pay for mine to be cleaned on the outside because its one less thing I have to do at the weekend. £6 a time to have them cleaned it's not even the price of a pint in some pubs

Seems reasonable.

I wouldn't kick up a fuss though, it's just one of those things that happens when living with other humans within 100m.

Just be glad daughter wasn't gouging the babycave and a porno situation did not occur?
