We know who it is and we have access to video footage that shows him driving into the street - then leaving 20 minutes later - but not actually doing the keying.

We also have his number plate and insurance details.

Can my brother put a claim in for the damage against him or will it go nowhere and I'll end up shitting on the blokes face anyway?

Background : my brother is rogering the blokes ex girlfriend.

if you report him to the police and he is convicted, your brother might be awarded damages. whether he actually sees a penny of it is another matter.

It's nothing to do with the insurance company.

If the guy is prosecuted for keying your brothers car then that would, theoretically, make it more straight forward for your brother to bring a civil claim against the guy for the cost of repairs.

But I wouldn't want to bet on your brother ever seeing a penny from the bloke.

Victim testimony still counts for something. In conjunction with the CCTV and a motive, Dibble and the CPS might touch it. I'd mess up their numbers by reporting it anyway.

Don't involve the insurance cartel unless it's worthwhile making a claim against fully comp insurance after factoring in his excess: it'll be recorded as a loss against him even if he never makes a claim.

Popo were called at the time and promised to arrive swiftly. As of 1900 yesterday still no popo.

He also did the shouty shouty in the street thing as well with death threats and burning of houses down.. So they are actually relatively interested.

Despite them not showing up. (yet).

As to why he didn't go outside and batter the little gobshite. I have no idea. I can only assume an extreme case of wuss.

Update:

Police arrived at 2300.

Advised him that unless there is video evidence of him keying the car - they are not interested.

Also advised him that the text messages the guy sent him threatening him and her are useless as he could just say he didnt send them!!? Rolling Eyes

I've told him thats rot and its just that the uniform wearing traffic nazi doesnt want the paperwork.

I've also told him to get his camera ready any time he goes out front just in case. (and to man up).

First I would start with the head of the station.

Your brother should point out that he has been threatened and believes the threats are credible. That he has CCTV of the person arriving and leaving and witnessed the criminal damage.
Then he needs to point out that this puts him in a very difficult position, if/when the person carries out his threats how is he supposed to justify defending himself when the Police have already decided that he has nothing to fear?
