Evil or Very Mad What could be worse than binning my bike on the Wales ride out? Bining my bike and waking up the following morning to a speeding fine.

Needless to say I've spent most of my time searching the web for loopholes in the law. The only thing I've come across is that...
Quote:
If I claim I was the rider (which I was) by filling in the form (legally required) and tick the box to go to court instead of paying the fine. And if I don't sign the form (NOT legally required) then it can't be used as evidence in a court.

Anyone done this or heard of cases like it?

Brick Wall

What were you caught by, and what speed were you caught doing? Have heard about people getting off on the not signing it trick, but if I remember rightly it took them lots of time, effort and money to do so.

Was reading something in one of the magazines about people managing to get off by two people (who are both covered by insurance to be riding the bike) saying it was them riding at the time, as the police can't prove it either way. Laughing

I was cought by a 'Talivan'. For those that don't know, that's a van left on the road side with a camera in it.
Cheers,
Mark.

Pay it.

You speed, you take the risk. You get caught, you take the punishment.

Haven't we been here before?

But if there is a loop hole to avoid paying it thats a good thing. Smile And nothing wrong with trying to find a loop hole to get out of it.

I'm pretty sure that they've wisened up to these "tactics" by now...and I could swear that I read somewhere that the so-called loophole has been closed...or maybe not. Rolling Eyes

To be honest mate (and trying not to be judgemental), why don't you just accept the punishment? I know that it's a bitter pill to swallow, but if you did indeed break the law...

I agree with you Tin about just paying the fine. But thought if there was a loophole, it would benefit us all if we found it. I was prepared to try it to find out.
Cheers,
Mark.

Hi

Afraid that loophole has now been closed.

Try the Unsigned Forms list on Yahoo (groups.yahoo.com), and also the Pepipoo web site.

All the best

Basically if you don't sign the form then its the registered keeper that has to take the fine fine points unless they can prove it wasn't them.

If there is any disagreement with who was driving (assuming its a car incident for this example). Then again the registered keeper has the final responsibility and is given the fine and points. They don't just simply let you off.

Agree with everyone else, just pay the fine and take the points on the chin.

Marsbar, when/where were you caught?

Also IMO, you should just pay the fine, its easier in the long run just to accept the punishment rather than dragging it out to court where the punishment maybe harsher.

Hi All,

I'm in exactly similar situation as MarsBar.

I've only got my bike, a Learner rider on 125, caught by a camera doing 37 mph in a 30 mph zone! A form has been sent to me to complete, giving details of the person riding it.

I was the one riding it, but I just don't remember exceeding the speed limit as I might have been trying to escape from a potential accident.

Any input on this?

They really don't care for excuses as to why you were speeding, and they've more than likely heard every excuse in the book several times before. Unless there is some technicality or error on their part then it's probably best just to hold your hands up to it.

It was on the way to Llangollen Craig, you, Bella, Phil and Mike's dad were behind me at the time, I spotted the van so we have no need to worry. Pete and Alex were both ahead with Mark but they both say they spotted the van too, it was on the right hand side of the road, orange one it was.

The only way i can think to get out of it is to claim it wasn't your bike and someone has copied your numberplate. It'll only work if you live a long way away from where the offence took place and claim you were elsewhere with witnesses. This is about as dodgy as it gets and i wouldn't recommend it to get out of a small fine and few points.Mind you it could work.....unless of course they read this Wink Doh

It is entirely possible for this to happen, and not unknown for them to send the tickets to totally the wrong people.

All the best

Beware Exclamation Exclamation Exclamation Exclamation

If you do try and give a false story as to where you were and get caught that's perverting the course of justice which is a crown court job and prison time.................

Hey Guys,

Many thanks for your input. I think I will own up to it and pay the fine as well as get the points on my licence instead of having to find a way to wriggle out of it.

I never thought that I'd ever find myself in this situation, having had a car licence for many years without any penalty point.

Hi

Just make sure that it really was you speeding.

Last year we got a ticket for speeding on the M6 from a talivan. We were just going to pay it as it was quite possible we were on that stretch of road at the time. Then realised that they had sent a ticket for a car that had not been used on the road for about 6 months. As this car is quite unusual it is obvious that they had not double checked the photographic evidence as they must do legally to comply with the terms of the home office approval for the speed camera.

Incompetant theiving gits.

All the best
