Scooter MOT Question - MOT Exempt?

Someone asked me this and I didn't know so I'm hoping someone does.
The scooter is registered in 1962 as a 150cc, but has been fitted with a modern 125cc engine. It's tax exempt - I don't think it is MOT exempt as it would need to be pre-1960 - is that right?

There are a few rules regarding this 40yr mot rule.
The bike has to be fairly standard, certain parts must be original and other parts that are allowed must be period.
If you have a 1979 bike but it has a 1981 engine you might be ok as many bikes from that era had the same engine for many model years.
If it doesn't fit this criteria then you'll have to have it MOT'd

Worth noting that you have to declare that your vehicle hasn't been substantially changed, in writing.

No doubt there will be some sort of penalty involved, should it later be discovered you have made a false declaration.

Was thinking about that. I remember years ago I used to ride an old P125 which was registered as a 125 but had a P200 engine in. For the life of me I couldn't work out how anybody would know the difference unless they stripped the engine and measured the engine bore or pistons.

Easy, the 125's engine number would have started VN
The 200's engine number would have started with VL but i get your point. Its a bit easier to spot difference between a 1962 150 and a modern 125 though.
