8 years for killing the biker and perversing the course of justice? Only 8 years? And licence suspended for 6 years, ie he can go back to driving when he gets out? |

People confuse punishment and crime.
There are almost clear distinctions made in matters of law when someone loses their life.
Murder is usually a considered act.
Manslaughter is accidental or unintended.
Killing someone as a result of a RTA is like manslaughter.
Can we discuss death due to industrial accidents too?
The punishments are not always the same for similar cases.
It is the way society wants it.
It doesn't mean it is correct or fitting but it is done through rules and guidelines set out by law people and politicians who we elect.
So it is the way we want it to be.
There is a very interesting case of Ruth Ellis.

I agree it 'looks' like MURDUR. But the courts must look at the legal aspects. Emotions do not have as much to do with the laws once the law is passed.
Emotions can influence a decisions but the law must be upheld.
Even those the guy driving the mini 'caused' the death if the motorcyclist it was not necessarily MURDUR.
It was causing death by careless or reckless driving. (Not the exact word for the offence.)
There are too many variables and mitigating circumstances that must be considered when the book is thrown at someone.
The guy probably knew he cause the biker to crash. But he could also have been unaware of the consequences of that.
Folk are fcukin stupid. It doesn't mean they are criminals.
That is why we rely on the wisdom of our courts to decide the outcome.
People have 'Gotten away with Murder' many times.
And people have been stitched up for it too.

Not blaming the biker but it seemed odd going from lane 1 > 3 without noticing a car* that looked like it was trying to overlap him, reminiscent to accidents on here where people have changed lanes, and collided with a vehicle because they didn't do a shoulder check.
Obviously it was a cold rainy day so you have to factor in conditions. I blame Adam Aarons
*unless he did know it was behind him, then you wonder why he didn't let the tw@ go. |
