The law references the original listed factory power of the bike, so you can't do the old "I've left the gate open for the last 20 years and all the horses have galloped away" top gear defence.

That’s my point. The factory specification gives a weight too, so that’s the weight used to calculate the restriction.
HOWEVER. I can’t actually find a sauce for this. I’m sure it is the original factory spec, but it doesn’t actually say that in the Highway Code.

One tidbit of info I did find though is that a 2-stroke Aprillia RS125 making 33bhp has a power to weight ratio of 0.203kW/kg and therefore would need to be restricted for A2, for the sake of that 0.003kW/kg.

Quite simply, if you have bits that make a non-trival weight reduction or performance increase you have to declare it to your insurance. If you don't, you'll likely be riding without insurance and if you do ask your insurers you will likely be told they won't insure you as bike no longer legal.

When I had a 33bhp restriction (2012-2014) it was an utter ballache when i needed an exhaust repair as neither my insurers at the time nor anyone I phoned would insure a restricted bike without the OEM exhaust, although that may have been in part because the restrictors were placed in the exhaust headers on that particular bike.

43 bhp should be in the limit? A2 licence is 47bhp not 33bhp right?

OK serious now. If I had a KTM 390 at your age I would do whatever I wanted to it. Akra, ecu, lightening all good, would get the suspension and brakes sorted too.
The A2 thing is bollocks. Plenty of kids can kill themselves in unrestricted cars but you cant?
The fucking useless policing and government system in this country cant do anything about someone being stabbed to death in London every day so I doubt they will be bothered about your bike being 2 or 3 bhp over an unenforceable limit.
Yes its illegal, but who gives a shit? Unless your real name is Cliff Richard, then they'll be watching you like a hawk.

For the most part you just get asked for proof of restriction if stopped. carry photocopy under seat or in jacket. If brain-dead dibble thinks your bike is a bit brisk then they may attempt to test which will cause no end of headaches.

Unless you are loaded, you cant afford the insurance penalties that come with getting caught riding otherwise than in accordance to your license, particularly as that may invalidate your insurance and leave you at risk of being done for riding without insurance. I know 2 years seems like forever, but just suck it up and enjoy the 2+years no claims when you come to insure a bigger bike. And then only fit parts you know you can insure. When you're not restricted a loud exhaust that makes marketing claims of more than 10% power increases and other such gubbins will be a pocket-money exercise to insure.

There is also a power to weight limit, which comes first.

you can say what you want about 'what ifs' when it comes to police officers, a 47bhp bike can top a ton anyway so unless they catch you at licence losing speeds, they have no reason at all to dyno your bike especially if you have paperwork especially if its a 390cc (very small bike in person as in overall size) like it just wont happen. they aren't gunna sit there and weigh out your 400cc at the side of the road then dyno it at the side of the road when you have your paperwork because you put an after market end can on. If the worse comes to the worse your bike will be checked unbelievably thoroughly for ANYTHING amiss, by the Police and your insurance company. If it isn’t legal you will be absolutely fisted. It’s a highly unlikely thing to happen but it may. It’s not a risk I’d fancy myself, but it’s your call.
