Interestingly, I recall a drinking pal of mine (and at the time DSA examiner) who did discuss this very issue when they brought mod1 in. ie. if you are testing someone on their ability to do an emergency stop on a dedicated offroad facility, you must be prepared to deal with the consequences of them failing to do so. Otherwise, there is no point in having a test. As I recall, he was mainly concerned about the swerve exercise, because if you are testing someones ability to drive directly at a cone at 50km/h and miss it. What happens if they hit it?
He was sacked a couple of months later for adversely commenting on the sexual orientation of his line manager... That reminds me the time I started using reverse gear shifter pattern on my motorcycles and forgeting about it after the winter break. Then in spring, I got to an intersection, put it neutral, green light, press the shifter down (2nd gear), then of I went and in the middle of the intersection, revs at about half of the rev range, I lifted the shifter (1st gear).
Not nice and luckily the road was dry and I pulled away in orderly fashion. Imagine if I tried to drag race someone and did that at however fast a ZX7R can go in the second gear and then kicking it into the 1st gear.
