Bit of an interesting one this.

Biker killed by US diplomats wife, family flown back to America before arrest was made.

I was under the impression that all diplomats families had diplomatic immunity however unless I've read it wrong it seems this woman hasn't or they just don't want it in the news.

So the Yanks pull the family back to the US and is that the end of it?

Also, what do you think would have happened if it was a Brit diplomats wife in the US. I reckon she would have been thrown straight to the wolves.

Usually there's a "gentlemen's agreement" that diplomats who do something serious (like murder) volunteer to stand trial but everything else is either ignored or gets you booted back home.

There'll be an inquest. If it's just a basic accident then that's that but if the findings are more serious the FO and the CPS will get in a huddle to work out how to bury it.

It wasn't a basic accident. She was on the wrong side of the road and the poor lad headbutted the car. Given the current state of the administration over there though, I very much doubt any fucks will be given.

this is, unfortunately, the nature of diplomatic immunity.

Dimplomatic immunity prevents us (and every other country) putting undue influence on diplomats by trying to apply the country's laws on them. The downside is that they are , to all intents and purposes, exempt to the law. All we can do if kick them out.

By the same token, our diplomats cannot be imprisoned for on trumpted up charges at the whim of leaders of other countries.

It would appear neither Mr. or Mrs. Sacoolas are under the protection of Diplomatic Immunity:

Unfortunately an agreement was made concerning personnel in general on the base rather than just "diplomats". This I think should be immediately reviewed.

An inquest should be established in this case, diplomats or no diplomats anything involving death should be investigated to an agreeable conclusion.

I was under the impression that her husband's activities at that base qualified him for diplomatic immunity in the UK but that his missus, as a hanger on, was not.

The media reporting takes a bit of reading between the lines regarding the Interpol position, I checked their red list yesterday and she wasn't on there. Seems she'll be listed when she enters another country. Interesting to note that it'll probably be enough to fuck up her future travel plans as nearly 200 countries are signed up to Interpol and nobody wants the local plod descending upon them and holding them for whatever that country's maximum hours without charge are just after they've cleared customs...

Sadly this abuse of the Diplomatic Immunity goes on all the time but most aren't news worthy.

Every so often you get a story about some Arab diplomat's son who's racked up some X000's of pounds of parking charges in his Ferrari or some bint going on a shoplifting spree.

I suppose it's easier for all concerned to ignore it until something like this comes up and shows how the system is open to abuse. Then you procrastinate enough and hope it all goes away without rocking the boat too much. Rolling Eyes

I was under the impression that diplomatic immunity was something that you had to apply for in writing and have granted (or declined) in writing.
