You've got to read the terms and conditions of travel insurance policies carefully. Pre-existing medical conditions have to be declared, and if they are not known about beforehand by the policy holder, then the terms of the policy will probably absolve the insurer of any liability. The boring small-print will usually have a clause in there telling you that if you need medical treatment, you should inform the insurer immediately. It probably also point-blank rules out private medical treatment or overnight stays for any period longer than 24 hours, and says explicitly that you're expected to use public hospitals and clinics. When you're in the care of the doctors/hospital, the insurer is still the boss, no matter what the medics say. The policy probably also instructs to not sign any medical forms or papers whatsoever without the insurer's approval. So, if you or a relative goes down, you have to be on the blower with the insurer for every move. Doctors'/hospital preliminary checks, blood, heart, etc. you're probably OK. Anything beyond that, you seek permission.

Too late for that bloke, but just posting this in case it could be useful to someone in the future. Getting involved in an accident, or falling ill on holiday, isn't fun. But the most important thing is, if it happens, you need to be on the phone to the insurer the whole time, sit through their menus, explain it all over again a dozen times, endure their call hold/queue music, etc.

Perhaps the OP would like to comment and clear this up for us. There seems to be a lack of information.

I'm not at all clear why it isn't possible that the estate could bear the burden of the deceased's death. What's the explanation? Are there lots of other debts to pay, a mortgage, etc.? What is the value of the estate?

What steps have been taken to inform the Spanish medical practice that the estate is in the process of being administered by an executor? What timeframe has the estate arranged or been given to clear this debt? Has the estate taken out a bridging loan pending resolution of any complaint or resolution process against the insurance company? Is there any complaint/resolution process in progress currently?

What are the grounds given by the insurance company for denying liability in this case? The page says they're trying to "wriggle out" of paying the medical and repatriation bills. That makes absolutely no sense. They would have refused, with reasons. What were the reasons given?

As it stands, a stranger dies, and someone says, literally, "just give me" to the whole world. This is not in the least bit dignified, to be frank, especially given the lack of circumstantial information.
