Ok so I'm employed as a mechanic, been here 26 years now, I was forced to sheild until August due to medical issues. While shielding I was getting very little money as the furlough was based on what my boss says he pays me.
Had a day off today for a hospital visit, and got told last night that I have no holidays left to use because the boss had been topping up my furlough by 20% and didn't think he should pay me any holidays because of this.
Advice on how to tackle this ?
I've had enough of it and am going to find another job ASAP as it seems 26 years of employment means nothing.
Is this legal,?

Sounds like a lot of fiddles going on. When you say you were being paid what the boss said he paid you, did you get a lot of cash in hand work? If you were OK with this then you are the making of your own problems.

If not, then take him to court, bubble him up.

A good boss will tell you honestly what's going on even if the last part of the conversation has to be "...let's just keep this to ourselves." I take it you were informed of the "holiday in lieu of 20%" after the fact?

Find another job then consider Ste's suggestion Wink

He doesnt have a choice on holiday, even if furloughed, any holiday taken must be paid at your full rate. His choice to top you up, but Id be suprised if a lowley mechanic earns enouvh to get above the cap?

This is the same boss who let you use his tools and machines for your own ends Smile just sayin..don't cut your nose off to spite your face.

So...

You're entitled to a minimum of 5.6 weeks holiday per year...

I'll assume you work a 5 day week, this works out as 5.6 * 5 = 28 days holiday a year, let's assume the 8 bank holidays are removed from this (which is all legal etc.) this leaves you 20 days holiday.

If he's been topping you up from 80% to 1000% this is the equivalent of 1 day a week (for a 5 day week).

So work out how many weeks you were furloughed for and he 'could' argue that you've used that many day's holiday allowance - although he'd be hard pressed to prove that if you've never put anything in writing to ask for or agree those days off.

The fact he's been topping you up is a good thing, I know lots who haven't and also some who had to accept pay cuts.

Ok to clarify, my he has been topping up by £40 a week my total furlough money was 270 a week. I was not aware that he was topping up anything or that I had forfitted my holidays.
Yes I was using his remap equipment but he was still making money off it through me ,I've since bought my own anyway.
My usual wage was almost double of what I have been receiving.
But yea time for a change I think tbh

Then he's not been topping you up if you've been getting less than what you were entitled to, he's been skimming money off you.
