What does Single Justice Procedure mean? They know someone is lying and are after them or just that she/he/they/them is going to get arse raped for the speeding?

38 in a 20 was never going to get an awareness course. More like 4-6 points and a fine of getting on for £1000 (reduced by 1/3 for a guilty plea I think - which will involve them committing perjury Very Happy )

What an idiot.

Why do people do this? PCOJ can end up with a custodial if you're caught.

I would be thinking of getting back to them and saying "I've just checked my diary and I realised I couldn't possibly have been driving that day. Honest mistake guv! Sorry!"

Under the old system you'd have to attend a magistrates court where a bench (usually 3 magistrates) would hear your case.

It's now been streamlined so just one magistrate (a "single justice") can process guilty pleas by post without you having to attend.

If you go for "not guilty" you'll end up in a physical magistrates court.

I think that's how it works, anyway.

Nope, was still 3 beaks if you have to attend when I was up for 95 in a 50 a few years ago.

It covers the whole process and you can plead guilty by post, accept a fixed penalty or course by post, or plead not guilty.

If yoiu are going to be banned (maybe inprisoned as well, can magistrates do that?) or plead not guilty thats the only time you have actually attend court.

Yeah, sorry I wasn't clear - if you have to go to court, it's still 3 beaks.

But it's called 'single justice' because up to that point, it only goes through one of them.

In the old days, you'd be in front of the bench just for a simple guilty plea.

Yes magistrates can imprison you for crimes such as drink driving, but only to a maximum of 26 weeks I think. For longer sentences you would be referred on to crown court.
