Well, the weekend after my friend died on his bike in september, me and another friend were having a small ride out. Going through the village of Airmyn, the road narrows to a single carriageway, with on coming traffic having to give way to traffic travelling in our direction. We were dominant, and passing through the pass. When an audi A8 driven at high speed by an old woman (45+) chatting on her mobile ploughed through without giving way, and almost killing me and my friend, we had to take avoiding action, and he ended up mounting the grass to avoid her.

Given that 3 days earlier our friend had been killed in front of us whilst out on our bikes, we were a little sensitive, and this plain arrogance demonstrated by this driver, was the straw that broke the camels back. We spun the bikes around, and gave chase...

Catching the car up, i over took her, and forced her to stop, whilst my friend pulled up behind to prevent her from backing away. This wasnt the plan, but is the way it has looked.

I started to talk to her, calmly i may add, asking why she was on the phone, and why she had almost taking us out. Asked if she;d even seen us, and then when i got no reply, i explained politely that id already lost a friend through car drivers, i didnt want to lose anymore, and would she please take not and change her driving style. To this she replied... "i couldnt care less about your stupid mate!"... anyway, i flipped...

Started shouting at her about how i hoped she'd crash into a ditch and die, how her kids would feel having no mum, about how its generally the older "mature" drivers who kill bikers through the arrogance and lack of observation... she started shouting back "do you know how pathetic you look in your leathers"... to which i replied with a swift fist swipe and took off her wing mirror.

Anyway, last night got a phone call from North Yorkshire police, they're investigating a case of major road rage, and its me. They have received an allegation of the above from her and her solicitor, and the police are looking at charging me with: Criminal Damage, Breach of the Peace... and the best of the lot.. False Imprisonment!

So, i ask the wise masses out there.... what are the likely outcomes of these charges... i agree to Breach of the peace, going to deny criminal damage and the mirror thing.. and false imprisonment.. well, what can i say aout that?

Any comments welcome...

Tell them the whole situation, why you did it and admit to it, tell them your story. You might get let off leniently, I guess its just going to be a criminal record and a fine/compensation.

She was breaking the law at the time, by speaking on a hand held phone, so by my standards, your actions were completely understandable.

But I do honestly think you should go in ASAP and tell them exactly what happened, don't bend the truth. Your actions were done under the fact that you lost a good friend a week or two beforehand.

Speak to your lawyer firstly but I honestly think you shouldn't lie or try and bend the truth at all.

Don't admit to the wing mirror, whatever you do. All the other stuff can be dealt with more easily, as there are lots of ways of interpreting what happened. But the wing mirror is a black and white thing. Deny it.

I agree, just be totally honest. They should take the whole situation into account, and if she lies about the phone they'll have her.

I shouldn't worry about it too much.
Sounds like a classic 'she said, you said' incident - the sort the police can't really resolve if there are conflicting stories from either side without any independent corroboration.

To put into context at an incident recently with kids throwing stones and eggs at houses the police that turned up said '..because we didn't see it there's nothing we can do about it...'.

If your mate also saw she was driving whilst on the phone that's must be in your favour (2 similar accounts to 1).

If you are interviewed in relation to the criminal damage and you deny it, then you will have to go to court if they decide to charge you anyway. Admit the offence and you could be eligible for a caution.

True though. I was there and heard this. No photo/video evidence of anyone throwing stones/eggs. So couldn't detain anyone (this despite the group of about 12 lads still hanging about taunting them).

I don't dispute that's what was said. It's bollocks though. All you need is to suspect an offence has been committed (the broken mirror) and a person making a complaint. An alledged offender could then be lawfully arrested.

In terms of what Scratch and Map are saying, it is no doubt true the kids could have been lawfully arrested, but they were probably not nicked because it would have been difficult to charge them and pursue the case through the courts without any evidence.

Scratchy - I agree with you. I posted mine before I saw yours. It is all this Human Rights bollocks. Now I think Blunkett is a total fascist, but to be honest, I would rather return to the old days when things were a bit less regulated and a copper could just slap the kids around a bit, and they would behave a bit better.

She sounds like a right stuck up bitch. (with money). I hate those rich snob types Mad . Used to get them all the time in Halfords. . . They think the whole world should bow down to them.

Just make sure they know how she was driving, the fact that she was on a mobile, and nearly/could have caused an accident etc.

Then hope they won't throw the book at you. The only really bad thing you did was to break the mirror, well IMO anyway... Rolling Eyes

If someone does something wrong they should know about it.

I think you did the right thing there.
The police usually take the time to hear both sides, remain calm and like said earlier make sure you and your mates stories tie up.
Shes drives a Audi A8, that should be enough againest her, snobby bitch.

When you life and you mates life has been in danger and no consideration taken i think a bit of a scare is a good thing, makes them drive carefully for the next few months.
I had a case where a BMW over took me going round a 2 laned corner (i was in the outside lane) inches passed me.
Thats fuking insane you turd!, i thought.

I wasnt letting that go, i got to the car window and started to try and open the door, i punched the window but then he drove off.
A few times after that, they had set up a police check thing, and when i was pulled over they mentioned about the road rage thing that had happend (i just acted shocked)
