Some of you may recall back in may this year, i got stopped while racing with my friend on his Kwak ZXR7. They had us for average of 93.44 over 1/4 mile.

I pleaded guilty to it, apparently they had video evidence, and i couldnt afford a lawyer.. and they had us banged to rights. I was at the back, so the vascar unit had my number plate.

My mate, pleaded not guitly to it, and there's a string of technicalities:

They recorded his bike as being a ZXR9
Got his address wrong
Didnt date the NIP
etc...

The biggest thing though is it turned out there was no video evidence.

They changed the charge to Opinional evidence and tried again....

It was heard in court yesterday.

His lawyer found another technicality... the officer oporating the vascar unit, said in his statement that its a hard job and requires 110% concentration to get it right.. and signed his name to it. Another statement was from the driver... saying that at those speeds at night, on windy roads, it also requires 110%.. but it was the same officer who signed it...

In court, the judge asked him... how can you do both jobs if they both require all your concentration.. he couldnt answer.... After some tough cross examination, the police admitted they had lied on the statements... and a not guilty verdict was given by the judge. He got off on it.. hes also been advised by his brief to sue the police.

Just goes to show, check the documents carefully, read up on the law, and if in doubt, get one hell of a good solicitor. It might save you some points or your license.

Nah fella. i still got stuffed for 5 points and a £300 fine.

Im appealing though. Saying that i couldnt afford a solicitor to argue not guilty in court. Now turns out they lied, so i want it reinvestigating.

Have to submit a Leave to Appeal Out Of Time to the Crown Courts, then if they agree, i give them a Notice Of Appeal and the case is re-opened.

I should win, the police were severely bollocked in court for purjury.

Fingers Crossed.

Why dont we have a system like in a lot of Europe where you just have to face a fine, not a silly points system Sad

The whole idea is to get away from people driving like twats, knowing that they'll only have to pay a fine. If you're minted then a fine isn't going to deter you. Points are the great leveller - everyone is equal.
