So a few of you know I was nicked for 72mph in a 30mph zone back in January but the Police officer only gave me a Fixed penalty notice as he didn't think I was driving dangerously.

I surrendered my old license as required and paid the fine by cheque which was cashed within the 28 days and then 10 days later my license was returned with no points on it and a notification that I was being taken to court as the license was defaced and that the Met was unwilling to deal with the matter through the FPN system.

I found the above a little strange as it couldn't legally be taken to court due to the way the Road traffic offenders act 1988 is written, I.E. if you comply no further action will be taken. I wrote a letter threatening to involve the Police complaints authority unless they could provide me with the legislation under which I was to be prosecuted and have just received confirmation that the case has been dropped completely so no points or conviction and had an apology in writing for the stress it's caused me.

I think this is the first case I've heard of where someones pleaded guilty, paid the fine and the case has been dropped. I didn't expect to get away with it just didn't want to lose my license as it would have cost me my job. Thing is now I wonder how many other people have been wrongly charged due to misinterpretation of the law by civilian officers?

jammy. 1mph slower then i did. And everyone flamed away Wink

Anyhew well done lad, law is a very handy thing to know abit about.
