Well as some of you maybe aware I have been having problems with my GPZ recently.

While at Keiths last week he discovered the rotor had dropped its magnets again (this being a rotor which shouldn't drop its magnets too!!) so we sent it back to Barton Motors whom confirmed that it was not the fault of the rotor itself and it was an installation issue. (Which was also confirmed by Keith)

The "mechanic" who fitted the rotor from Cadishead Motorcycles, seems did a bodge job. He is also a big gigantic hells angel whom you wouldn't want to mess with, and they are widely known not to be the nice place in the world and I normally never use them but I was stuck when the rotor first went.
My question is what is my legal position on this rather than just going to ball at them I want to try and get my money back properly. Do I go speak to a solicitor get them to send a letter to them or the CAB?

Any advice will be greatly appreciated,

I would go to see him first, most of them are good guys. He might suprise you by buying a new rotor then fitting it for free. Don't go in guns blazing though, being nice can get you a long way.

Then if that doesnt work go to Citzens Advice, as if you go to CAB first they will ask you if he knows about your problem with him.

i'd personally go and see them to see if they'll fix it for you, if not then take court action.
How much did they charge/cost you??

The bike is now repaired thanks to Keith, but Cadishead Motorcycles charged me £60 for the work, and the rotor was £150.

That rotor is now not usable at all so, I would expect them to give me the money back for that too.

I shall go speak to them tomorow, though as I said they are not the nicest place in the world!

Speak to them first and if you make it back out with all your limbs intact Laughing without resolving it write them a letter explaining the problem and how you want it rectified.
(I am sure CAB will be able to clarify your legal position. I seem to remember a thread a while back involving Ste and some work on one of his bikes which wasn't done correctly; could provide some pointers on how to go about it?)

Go and try to sort it amicably before going in quoting laws and threatening court action. That would only piss them off more.

Be prepared ro stand your ground and argue your case. Do you have a written statement from the place the rotor came from to the effect that it was installation error?

Surely Cadishead Motorcycles will just say that they did nothing wrong and the work was all done correctly and so there must have been a fault with the rotor from Barton Motors and so it's absolutly nothing to do with them? Can see it being made nicely complicated by it being a second hand part bought from one place and fitted by another.

I'd also expect that you doing work and repairing it with Keith will also allow them to just say any problems were caused by you and so it's not their fault you decided to take it apart incorrectly.

Hi

I go with Col and say make sure you get a written report from Barton motors that it was an installation problem.

To go with what Craig says above when we took the alternator cover off there were a few bits of magnet missing. I later looked in a bit more detail and noticed that there were wear marks on the inside of the alternator cover in a few places and my guess would be that the rotor had been rubbing (although it is possible that the marks are from the old original rotor).

Measuring it up I cannot see how they would touch as it looks like there should be around 3mm of clearance.

Here is a pic (but 1.5mb or so).

The only thing I can think of is that they installed if without it being keyed into place correctly (is is located with a woodruff key), started it and had a nasty noise so took it to pieces again and found the problem.

It was a new part.

They might well try that, although the damage was visable in several places before fully removing the cover and I cannot see any possible way for the damage to have occured taking the cover off.
