The night before last, my Motorhispania was stolen from my garage. The door was locked, but some how the little fuckers broke in took it. They smashed the window, and unlocked the window from the inside.

Needless to say i was pissed right of. However i live out in the country so I knew exactly who it was because there is only one little ned (chav) that lives near me.

So yesterday morning i went down to his house, i was quite polite considering what i was there for, knocked on the door and asked if the kid was in. His big brother said yes but i aint getting him for you(we had a fall out a few years ago) then he shut the door in my face. I knocked again, he pushed me off the doorstep. I was very annoyed at this time so I just lashed out, smacked his face a few times, got a few back.

His brother(the suspected theif) came down and I asked where my bike was. He said i dont know, but he kept looking at his shed. I went over looked at his shed and there she was, my Motorhispania. It was a mess, with a burst back wheel.

I told the wee turd to expect the bill for this. but that was another argument

So I get the bike home and 2 or 3 hours later the police are at my door step. They arrested me for assult. But no mention of what happened to my bike. ( I did phone the police about it at the start).
So I got a warning and let home.

What would you have done if you were in my shoes???

Dunno, did the police go round and recover the solten bike? At least this would put some guilt on the thiefs...

A warning for a blatant assault on someones doorstep is alright. The old bill were on your side by the looks of it. Blame the fucking twats that grassed you up. The police had to do something, it was probably a 999 call.

Do not expect the police and the law to work for you. Unfortunately it's those that don't care about the a small risk when breaking the law that can usually get away with a ridiculous amount.

Did you tell the police that you thought the bike was there? Did they say they would act upon it?


If you're going to involve violence, I'd try and keep it seperate (ie pop around on another night when you might have an 'alibi').

If he pushed you off the door step you could also construe that as an initial assault, with you defending yourself. Probably quite hard to prove either way.

there were no witnesses to the incident except......... the little brother who wasnt looking at this point.. I told my self on the way down not to get violent but it is hard when something you have saved hard for for years gets stolen.

I told the police i thought it was there but they never seemed to do anything. I probably should have waited till had been done..

To be honest if it was me i would be back around there pretty sharpish and teach the pair of twats a valuable and violent lesson
in what happens when you mess with other peoples bikes, the trick is to make sure they are too freaked out or scared to involve the police again .

This shit happens all too often.

You got off light with the warning but, remember you now have an assault on your police record. Do any thing like it again and they will probally lock you up. This is a total balls up but true.

Not much you can do now as I bet your bike has now vanished for good.

Try to be as sneaky as them next time.

You should have sneaked a look in there shed and if it was there called the Police and waited close by until the cops arived. Saying that, they would probally have knicked you for trespassing Rolling Eyes

Sounds like you got off ok with a warning, even though it is not justified you're right. And to be fair to you, you only hit him when he shoved you.

Might be worth trying to get some legal advice (CAB) regarding getting money back. I suspect that having this assault warning hanging over you may cause problems though.

shouldn't have smacked him one but can understand why you did.

As for claiming moneys back the assult would have nothing to do with your case. As (im guessing) the cost would be under £5000 you would have to fund any legal representation out of your own pocket.

I know this because myself and the mrs had to make the choice. If you win then nice one. But if you dont you would incure your own legal costs, the other persons legal costs and court costs.

Sorry.. i maybe was not that clear but i got the machine back.. and have just had a chat with the guy who lives across the road from the thug. He informs me ha saw it all and if i was not so hasty in hitting the guy he was gonna cum out and help sort this mess out.

Probably the exact same thing you done.

Even if you got a warning, they've probably learned a lesson not to come near your bike again. Still, you've got your bike back, and even if it is in a bit of a state, all can be repaired at their expense.

Did the police not even care about the fact they stole your bike in the first place and it wasnt blatant/unjustified assault?

Daft question, but you don't make any mention of reporting it as stolen or of the police doing anything other than arresting you, did they make a record of the fact your bike was found in their shed?. I can't see it being very easy to get that kid to pay for it if it's just your word against theirs with nothing from the police to back up what you're saying, especially as you've got a caution for assulting them. Confused

I reported it stolen in the morning (over the phone), they took my details, i said where i thought it was, Then i phoned the police a few hours later and they said they had not got round to it. I was just sitting in my house thinking what they could be going to it so i went down.

Although the kid is a little shite, his parents are nice people so will have to see what they say.

All the bike needed was a new rear tyre (Which I have got and fitted already) a good clean, petrol and the indicators were hanging off

The kid's family have to pay for any damage caused by the kid.

If I was you, I'd phone your local paper and they'll love a story like "Man's bike gets stolen - who gets arrested? Him!". Stupid policeman.

Or find the kid and superglue his face to the road, then run over him repeatedly with your (now repaired) bike. He'd get the message. But you might get arrested again.

PS It sounds like you certainly commited assault & battery, and possibly assault occasioning actual bodily harm (if you broke his skin). And unless you could claim self-defence, you'd have no legal defence. However in the same circumstances I'd do the same thing Twisted Evil

Just hope im lucky enough to find the tossers who nicked mine, because i will no-doubt be getting sent down for murder once i have finished with them. And it will be totally worth it. Mr. Green
