my mate sold his bike and the dad of the boy came to collect it he took all the V5 and promised to fill it in and send it back as soon as he got home to his son. Now he says he has had to take it to the mechanics and it needs £350 spending because somethings wrong with the engine and my mate should pay that ( bike only sold for £600) he says he wont send the v5 untill my mate pays him.

what would you do?

I wouldn't get into that situation myself, though the 'lets have all the V5' was tried on me once, very tempting when you have cash in your hand Confused

Maybe the best solution is to buy the whole bike back off him, the buyer is obviously taking the piss.

the guy wont let my mate buy the bike back for £600 he now wants £950 for it if he wants it back. If my mate just stopped talking to the guy on the phone and ignored his phone calls do you think he would stop. Whats the legal side of it?

Not sure, I've not done it before. DVLA route is probably the safest, as not many thieves have the v5.

When I sold my car, there was a mixup with the V5 and the new owner took the wrong half by accident. I called them up about it and they said they would send it off but they never did. So I sent a letter to the DVLA explaining what had happened and they transferred the details to his name.

Writing that out just now I've just realised you might not have all his details.

As it was sold privately the guy has no real right to expect you (or your mate) to pay for the work. You did not sell the bike with a warranty. It's a risk you take buying privately.

If he didnt get someone to inspect it first, then more fool him.

Call the DVLA and explain the situation to them. The worst they can really do is go through speed camera's and hope you get done.

Incidentally, it may be worth mentioning to them that if that happens you can advise the police of the riders address. Also on that thought, If they have insurance and they say they own it, but the V5 says it's registered to you, that would invalidate their insurance. So they are breaking the law twice... You may find they'll quickly change their mind.

Doesn't matter if he sends it or not, just tell your mate to inform the DVLA that the bike has been sold and the date it was sold on.

i owned the bike first and then sold it to my mate 4months ago so i cant believe it has any engine problems what so ever, its only a 125 but its been all over the place.

When the guy came to collect it he started the bike up and left it running a while and said he was happy with it for his son. It has a bit of cosmetic damage which is why it was only £600 - when you would expect to pay close to a grand. The lad even emailed my mate saying he liked the bike and was there anything to make it faster and then 5days later he says its at the garage and says the mechanic says the problem is over a month old.

Your mate has sold the bike, just tell him/her to forget about it now. It was sold in a 'sold as seen' condition, he was happy with it when he took it. To be honest, your mate has nothing at all to worry about.

Did they actually say what this problem is? Cant see how a garage would be able to tell how long a problem has been there for!?

DO NOT give this guy any money!

DON’T GIVE HIM A PENNY


First send a letter off to the DVLA recorded delivery explaining exactly what’s happened

Second make a Complaint to the police about this chap trying to extort money from your mate with threats.

Don’t bother to inform the buyer you have taken these actions.

Then forget about it even if this dick head does something like running past speed cameras or getting parking tickets. You can contest it all and back up the claim with the police incident number and the proof of receipt of the letter to the DVLA and land the arse hole in some real shit.

Did you get the buyer to sign a bill of sale?
If so then I'd write to the DVLA and just say bike has been transfered.

just take a bat to him if he complains or threatens him.
otherwise the bike is not his no more so the tickets cant count as long as he denies it within 7 days and shows that he dont have the bike anymore

I've recently transferred my dad's old MZ 250 back to him after receiving another tax reminder, despite sending the log book back. I just needed to fill a form in et voila! Ownership transferred. Of course, I needed to supply his details in order to do it, so they're essential.

your mate was nieve to do that but hey you don't expect people to be pricks!

When i brought my car i got it of an old man, very nice bloke, but he gave me all the documents not filled in!!! i could have done anything and he would of been done as he was still the owner.

whether you trust buyers or not protect yourself and fill in the details and post it yourself, there is no reason why someone should say i will do it!!!!!!

Hope everything workers out for your mate, if i was him i would contact the DVLA

Hi

Think it is an offence not to tell the DVLA, so both your mate and the new keeper have commited that offence.

Tell the DVLA immediatly. Possibly try and tell them by phone, and get the correct address to send the letter to (or they might advise you of a form you need to fill in).

The new owner of the bike does not have a leg to stand on as far as claiming back the £350.

i would just tell your mate to dontact the dvla and have them put it on record he is no longer the registered keeper, after that he has no probs since the cash is in his hand and its the other guys issue, if hes feeling nasty he could tell them its been scraped Twisted Evil

if the new owners get in contact tell him to issue the command " go fuck your self" then hang up, they will soon get the message, dont buy the bike back as i wouldnt trust what they had done to it since buying it.

seriously though i would advise sorting it out, the previous owner of a bandit400 i bought never sent away the docs so i could ride about not having to worry about speed cameras and then sold it on to a mate, nether of us did anything bad intentionaly but the bloke who never never sorted it could have got into some shit for it.
