Iv got this friend who has been riding his Yam SR125 on his CBT for nearly two years. Well hes MOT ran out just after his tax so he could buy his tax.

He never got another MOT so he has been riding around for nearly a year with NO MOT.

He crashed on last night!! into a cop car!!!!! dont ask me how but he did!!

The question is what is he looking at for no MOT? 6points and £1000 fine?

He is being done for riding with un-due care or something.

We dont know how much shit he is going to be getting in, someone please help

Sorry to say there is no excuse for not having the MOT. especially after nearly a year.

I reckon they will throw the book at him... He needs to face up to a bit a time in a locked institution arguing with Bubba about who's gonna pick up the soap.

well also face up to the fact that the insurance may not pay out! If it can be reasonabe to assume that the bike was unroadworthy due to no MOT!

I dont think it matters if the bike was roadworthy or not. Most insurance companies stipulate that if the Bike is subject to MOT then you have to have it.
Knowing Insurance companies this is just the kind of thing they will jump on as an excuse not to pay out for any 3rd party claim.

I gather he was insured??????

If they know its been without MOT for nearly a year, i recon they will take away his licence (presuming hes on provisional with MAX of 6 points). If they dont know that i recon he might get away with it

The only way i can see him getting away cleanly is to bung an employee at an mot garage close to where he crashed a few notes and get him to say the bike was on it's way there for an mot.

Of course if he has already told the cops he had no mot then there is no way out.

The no mot thing isn't too bad providing the bike was not in a dangerous condition, probably a £100 fine. But as said, it's the insurance thing that is the killer.

I was once caught for speeding and had no insurance (years ago now and i did learn my lesson), and i had to go to court where i somehow managed to talk my way out of it and got away with nothing. No fine, no points but i was lucky.

They tend to prosecute to the max when the accident involves a police vehicle. My mum got a 2 yr ban and a £1000 fine for reversing into one.

Driving without due care and attention is fair. If you go into the back of anything, it's your fault. Say an enzo has to slam the brakes on, and you have an old fiesta... you were at a safe distance, but the enzo stops way quicker than your car. You rear end it. Still your fault.

As for rear ending a copper? You bet your ass they'll be harsh on him. If the MOT is a few weeks out of date, you could get away with it. Theres no real excuse for not having an MOT thats *that* out of date. If the bike is in good condition, he should have had the MOT. Costs bugger all compared to a car anyway doesnt it? *isnt sure on that*

How old is he? Age could be a factor.

Soap on a rope.. rofl.. that was class Toby.

If driving without due care is a 6 pointer and he gets done for it then he'll be automatically banned anyway (as a learner) so the other offences are probably pretty academic - until he comes to try and get insurance in the future anyway...

My mate is 20 and his bike was fine before the cash. just had new tyres put on it as well as a chain. He is insured and has in date tax just no mot

Well, I would imagine they would just push for the greater charge of "Driving without due care" myself. The fact he has no MOT would probably be brought up in the case as an aggravating factor but not prosecuted seperately. Mind you, I am no legal expert.

He is probably looking at 6 points and a fine. Given that he has not passed his test yet, this will not affect his licence unduly unless the magistrate orders a double length test (I don't know if they can do this with someone on a provisional though). Chances are that his learner status could be a mitigating factor in the prosecution.

If they were being real bastards, they could give him five points which would leave him within 1 point of loosing his licence if/when he does his test.

I don't know what would happen from the insurance point of view, I suspect they would pay out but place a 'black mark' against him which might make it difficult/expensive to get insured in the future.

Whatever happens, if he is going to court (which he probably will), he should get some professional legal advice. Meantime, tell him to write himself a report of exactly what happened and what was said, details can get fuzzy several months down the line when you get to court.
