I was on my jolly way to school and I had my first accident.

All traffic was stationary and I was overtaking on the left(we drive on the right), suddenly I'm behind a BUS and nearing the end of a well known junction of mine. He was indicating to turn left and on the lane to do so, as was I even though I was just overtaking and not planing on going left. As such, I changed my position and overtook one more stationary car before going to the right hand lane.

Whilist passing the bus and going on the right hand lane, who was full of parked cars as always(meaning that no cars can use that lane, even though the left hand lane should only be used for overtaking/direction changes), I had no visibility whatsoever so I limited my speed and wasn't going much faster than 10 mph. when I am almost finished passing the bus I suddenly watch as the front of a car appears right in front of me. He obviously didn't see me coming and when I did(view obstructed by the bus) he was already blocking the entire lane. I slammed on the brakes but it wasn't enough and we crashed.

I felt the back wheel rise up, as it does in a stoppie and thought "fuck, I'm going over". But thankfully, I didn't. I stayed on the bike and didn't even lose balance.

His door has a dent and paint all over it, my front wheel isn't pointing as it should and if it's a write off, I don't know yet.

Who do you think is at fault?

I would say his from the diagram rather than the description (which confused the hell out of me!).

He was cutting across your lane and ran into you moving along that lane. And he should have given away to traffic moving along that road before turning (I.e you cant just cut across another lane when theirs something coming) so i reckon it was your priority.

Despite the parked cars, it looks like the right hand lane is still a lane so all the normal road rules apply, its not like it was a parking area or anything that you shouldnt have been riding through.

I assume you've got all the insurance details etc?

He say anything like 'sorry,' or 'my fault' or anything?

That shouldn't be a problem, I know where he works.

No, he didn't. He thinks it was my fault. I was in a shock and couldn't bring myself to think or argue, we just exchanged details but neither of us assumed guilt or apologized.

I dont know who's in the wrong. The diagram confused the hell out of me.

One tip though. If you cant see something but suspect it is there, GO SLOW. If you cant see it, it cant see you. If you cant see the driver, the driver cant see you. If you can see the driver, still expect the driver to do something bloody stupid.

Plan for the worst case scenario. I filter at 10mph through stationary traffic if I can see all the cars wheels and what way they're pointing etc. If you cant see a vehicles wheels, just GO SLOW.

As long as you learn that lesson you should be alright. Assuming the forks arent bent the chances of it being a right off are pretty slim imho.

The forks would be easy to sort out, if the forks are straight and the front is still wonky, thats some major damage - probably the frame being torn or twisted at the head.
