PostPosted: 17:00 - 21 Sep 2011    Post subject: New job.. Breaks? Reply with quote

Hi, recently got a new job at a superstore - during selection process ect asked if I had a driving licence and would I be interested in a driving role.

Yes was the answer to that, thought no more Smile

Then I eventually did get the job and it was for a Home Shopping delivery driver 36-40h a week.

First things first I'm only 18 lol, I've noticed on other companies you need to be 21/25 with 3/4 years experience and no points.

It's a 3.5 tonne van, I guess it's just different companies have different insurance coverage, but yeah.

Being a 'stressful' job your often pushed for break-time, so basically recently I've been having no break, just eating and drinking on the go.

I'm not moaning just asking - for say a 8am - 4pm shift what break time would you expect to have?

Is there anything legally wrong? As that's basically 6 and a bit hours solid driving about !

Cheers Thumbs Up

I work 8-4.30 as standard hours.

I get a 20 minute break at 10, a 30 minute break at 1 and then another 20 minutes at half 3. That I would say is pretty much a minimum. As and when jobs require though we'll be expected to work through, and site work is a different kettle of fish all together, just depends on your discretion then, as we dont have a buzzer telling us when we can stop for a break.

I heard that legally you cant go more than 4 hours without a break (note I said heard).

On a side note, your only young mate, all I can say is welcome to the world of work. Employers will take the piss as much as they can. There'll always be someone else out there to fill your boots.

Cheers man, yeah I know what you mean, standing on my own 2 feet now!

Hopefully as I get used to things more I will be quicker at getting back, and if not I'll just have a quick break when I'm out on the road.

I'd just stop and have a break after a few hours mate, there's not much from a legal standpoint they could do surely? I doubt they could sack you because you had a break after 5 hours solid.

Is it the sort of job though you can get stuck into and get all your drops done within a few hours and then finish, ala' job and knock? If it was I'd be inclined to steam into it and finish early and fuck off home.

Nope, read the link I posted. If you can find anything about 30 minutes in the working time regulations then you've got better eyes than me.

All this time I thought I was being mugged off, yet it turns out my employer is actually pretty decent with their break system.

The cunts.

Legal minimum for a non-driving job is at least one 20 minute unpaid break for any shift of over 6 hours.

For a driving job, it's actually supposed to be more:

You are still subject to driving hours regulations whatever you drive so after 4 hours you should be taking a 45 minute break.
If you have a smash the old bill could check your pod sheet, see no breaks and throw the book at you.

Your company will of course say you should have been taking breaks and leave you on your own to get bent over by the legal system.

Or a 15 then a 30 minute break during the stint.

100% agree. Get your statutory breaks written in to your schedule - you should have a union appointed or employee elected health and safety representative to back you up - or prepare to get shafted one way or another. I guarantee that if you have a smash or run over a box of kittens, your employer will 'find' documentation that shows that you were made fully aware of your responsibility to take a break

15 minutes per 4 hours worked is the standard. Most people will get it in 30 minute chunks middle of the day as lunch.

I work in front of a PC screen all day, the most I'm allowed to go without a break is 2hour45minutes. If you do have a union rep, get on to 'em and find out when you need to break.

I sub for a major supermarket, shifting white goods, NO BREAKS. Shorter days now they opened depots in Glasgow and Luton, but before that we would do anything up to 20 hours solid, now we do up to 12 hours, no breaks. As above, get caught out by VOSA or plod, they can't wash their hands of you quick enough, cunts.

This would be a minimum at 'any' place.

Interestingly just because you are self employed doesn't mean the company can put aside H&S or working hours. They are still liable under the law.

couple of points here.. does your new driving licence cover a 3.5 ton van (I'm sure they were putting a 2ton limit on new drivers??)
and does the van have a tacho fitted and are you using it?

personally I would try to stick to tacho regs such as 45min break within every 4.5 hours driving and you know you would be ok in the event of a problem then because as said above your employers would soon find paperwork to say you were made aware of the rules etc.
someone's shopping being 10 mins late is not the end of the world where as you feeling tired or distracted due to not stopping could be the end of somebodys world .

It has 'B1' and a picture of a van next to it, a tacho? I haven't even been shown around the van or how to check it. No training as such.

Perhaps this is why it has such a big drop-out rate.

Completely agree with that mate, I'm finding myself stopping now and then after deliverys having a little break drink of water, piss ect. I'm just going to take my breaks and see what happens, they can't fire me surely? lol

Thumbs Up
