PostPosted: 17:12 - 07 Feb 2006    Post subject: Questions about NIP's Reply with quote

I've just got an NIP for 55 in a 30, which is at very least 6 points and a fine.

I've had my motorcycle licence for over 2 years which allows 12 points, but I only passed my car licence back in August 2005. I'm pretty sure that once passing car test it resets to 2 years of only being allowed 6 points, this is what my driving instructor told me anyway.

I was in my car when I got done for speeding.

I'm not arguing that I wasn't speeding or anything as there is no point, I just want to know if I should stick my car up for sale or not basically.

If you reply please try and provide proof to back up what you say as I don't really know where to look and the thought of my licence being lost isn't exactly making me too happy right now.

IF the limit is 6 points then it means you can have 6 points and not exceed them, and keep your licence. Just like it's possible to have 12 points on a "regular" licence. it's the 13th point that fecks you up.

Note the first driving test. If you have had a full licence for more than two years, you should be fine.

Ahhh really, so either way then I technically shouldn't lose my licence. That's good to hear...!

I got the NIP today going to send it recorded now, hopefully they'll go easy on me for receiving it back so soon.. Laughing

I'd seek clarification on that.

it MAY mean the first test for each vehicle on your licence. remember, you may have had to resit (eg killa).

Its 6 points or more within two years of passing your first driving tests so you've got 12 points to play with.

The Road Traffic (New Drivers) Act 1995
"If you reach six or more penalty points on your driving licence within two years of passing your first driving test, ie during the probationary period, your driving licence will be revoked. The Driver and Vehicle Licensing Agency (DVLA), acting on behalf of the Secretary of State, will automatically revoke your driving licence when notified by a court or fixed penalty office. There is no right of appeal against revocation under the provisions of the act. You may only appeal against the conviction, which led to the revocation of your driving licence through the convicting court."

fair enough... seems strange that they treat 6 and 12 point limits differently.

Not a chance. You've made the assumption you're dealing with rational human beings. You've admitted you broke the law. Therefore expect to be treated like scum.

All this IMHO BTW. Have a nice day Very Happy

They don't. 12 points and you're out too (well, you can ask for leniancy, say you need the car for your job, etc. and the court will probably let you keep your licence - once).

OK then, we're pretty sure that Sparks's licence won't get revoked as the 6-point rule applies after your first test.

But lets say for arguments sake that he was within the 2 years. I've been googling, and I can't find anything that tells me what happens if you have more than one entitlement when your licence is revoked.

So, if you have both car and bike tests passed and you get your 6 points within 2 years, you lose your entitlements (not your licence like you would with the 12 points in 3 years rule) and you go back onto provisional for all categories. How many tests do you have to pass to get all your entitlements back? Two again, or just one?

Only one test is needed to get reinstatement of all categories.
