After getting an NIP for 55 in a 30 earlier this week, I've now just gone and had a bloody accident.

Coming out of Southampton West Quay dock 10.. turning right, the light was GREEN so I carried through and turned right and next thing I know there was a big thump and a blue BMW went sliding past my window.

He was really going pretty damn fast as he spun out a good distance from my car whereas I managed to stop pretty much instantly.

I went on a green, he says he went on a green too and that I should have given way, a witness, who I believe the other driver is friends with says that "this happens all the time here" as the green filter light doesnt seem to operate all the time or something.

As far as I've always known with filter lights, if the filter light is not lit but the main light is lit green, and there are no RED lights then you're free to go yeah!?

Cosmetic damage to both my car and his BMW, his BMW is quite bad though... mine has fucked bumpers/dented bonnet/indicators etc but I'm only TPF&T so I won't be able to get it fixed... Sad Easily a grands worth of damage I'd imagine.. it's still driveable though so I'll prob just get the indicator fixed and leave the rest....

His BMW has large dents down right side and skirting bits were damaged.. not the worst damage ever but definetly quite a bit.

Not sure what to do now really, gonna ring my insurance company tomorow and tell them all the details then presume they'll tell me what to do from there.

Can't believe this really!! Not sure if it's my fault or his fault or the lights fault or what, obviously I didn't admit to anything at the scene... I just gave him my number, got his and left to be honest.

I gotta go court about my speeding ticket, if the fine was lots or I get a ban or something I planned to sell the car to pay for it, but now obviously I can't Sad fooked really.

Not really having any luck at the minute Sad

I would have thought if the main lights were green then you were right to go. Would need to see it though. Unlucky. Confused

Unlucky mate.

If that law about all lights being green is true (look into it) then consider filing a claim against the council for not correcting the problem and having caused the accident. If it isn't legal or there's no route that way, just hope for a 50/50 settlement. Sad

Sadly the green light is listed as "Go if it's safe to do so" in the highway code I believe, though few of us do check regularly, even when riding bikes.

50/50 settlement just means they both get shafted, he'd be as well off as if he took the entire blame. Been there, done that. Crying or Very sad

Depends. When it happened to me I was third party and the other guy was fully comp. I got hee haw. Crying or Very sad The other guy obviously got a payout as he was fully comp, but he lost his no claims discount. I know this because he tried to take me to court and sue me for the money. Well I got a NIP through and it didn't say anything about points/fine etc it just said "intended prosecution" and some other bits, I just assumed it was a court thing as I thought that if it was just fine/points that I'd have had to send a cheque off for the fine straight away Confused

Just looking at the forms it implies court... I'll just have to wait and see what happens.

Hopefully that's all I'd get! Confused I just thought if it was a simple fine + points that you'd get the form to fill out with the NIP of what to pay? Or do you get a form to sign to admit liability before getting info on the fine etc?

The only complication is that the road I was on is classed as a school Embarassed before I get flamed... 1) it's a dual carriage way, 2) it's not a school, it's a college and the college is fenced off from the road anyway Confused and 3) it was clear, emptyish road and I only sped up to overtake a car.. was hardly dangerous whatsoever... I think that as it's "classed" as a school thats why I might have to go court Confused

Funnily enough, when I was caught, It was outside a school (on a Saturday Wink )

Don't know what the form is like which you got. I've only even been caught speeding by a copper. Don't know if the form is different if you get it in the post?

Well then I REALLY hope I just get a £125 fine and 3 points! That'd be proper lucky considering.. will just have to wait for their next correspondence before finding out. Sooner that gets sorted the 1 less thing to worry about.

It really REALLY would be to easy to point out some various amusements from the past...

But would i... Wink

Anyway you get given the nip, then another letter comes throw saying what you get. You'll get a £60 fine and 3 points AFAIK.

Certainly aint going to court fella.

As for insurance, while its fresh in your head scribble as many diagrams as possible.

Cheers.

Hi

Sorry to hear about that. At least you are both OK and not much damage.

Free to go, but so are those coming the other way. Green filter light generally means you are safe to turn that way.

I take it he was coming from the opposite direction and you turned across in front of him. Unfortunatly I think that probably means it is your fault.

All the best

i think the green light in that case means you are free to use the filter lane into the other road but you still need to give way if there is any traffic

check the road markings, if there is a dotted line that you crossed, you should have given way

it might be time to brush up on the highway code and sticking to speed limits for a bit until you get the hang of it.

i think you make your own luck, and if you do things differently you will probably stop having 'bad luck'

But not always.

Green turn left filter lights quite often don't stop oncoming traffic or traffic travelling perpendicular to you.

All the green turn right filter lights I have encountered have only gone green when the oncoming traffic has been stopped. But that's not always the case as my wife found out when she turned right on a green filter light into the path of another car that came straight through towards her "on green".

No need to sound so condecending colin! I've been driving on the road for almost 4 years now with no accidents, speeding tickets etc... only been driving a car 7 months but its pretty much same as the bike.

A GREEN ARROW may be provided in addition to the full green signal if movement in a certain direction is allowed before or after the full green phase. If the way is clear you may go but only in the direction shown by the arrow. You may do this whatever other lights may be showing. White light signals may be provided for trams

153: Green filter arrow. This indicates a filter lane only. Do not enter that lane unless you want to go in the direction of the arrow. You may proceed in the direction of the green arrow when it, or the full green light shows. Give other traffic, especially cyclists, time and room to move into the correct lane.

Highway code reads that you can go on the main green light, if safe. I know where you mean, and the filter lights only comes on when the traffic from the opposite direction is on red, (ie, when it is safe) I would have waited for the filter light.
Insurance wise its your fault, 100%. Sorry!

Thats pretty gay sparks. Thumbs Down

About the speeding, you would need to have done 56 to get 6 points, 55 is just a standard 3 points and £60. I was caught doing 55 coming off a roundabout in a 30 but got away with it in the end. Cool

Caught last week 37 in a 30 and 59 in a 50 a while a go and had nothing either. I think im a lucky bastard with getting away with speeding fines. Cool

It depends on the area I think, probably also on if they've filled their quotas.

When you mention a few that you've been 'caught' then 'got away with' or 'had nothing', what exactly do you mean?
