Not true, it's not illegal or against the law to owe money. The only time you can be prosecuted is if you owe the state i.e. tax or fines.

If they obtained the money without any intention of paying it back then isn't there an offence of obtaining money by deception that would cover it?

Only if you say pretend to be someone else or put down false details as quite obviously you are decieving. If you get credit correctly in your own name like a credit card and don't lie on application you cannot be prosecuted for refusing to pay.

I'm pretty certain that if you borrowed money from a bank without any intention of paying it back, it could become a criminal matter. I believe this would actually be classed as theft.

It's not an offence to borrow the money, but if you borrow the money on false pretences (e.g. not going to pay it back) that would become criminal.
