Rightio, back in October I purchased a pair of Alpinestars SMX-3 boots from Custom Lids up in Newcastle while I was learning to ride.

Passed my test in November but didn't start wearing them til January, now, nearly 4 months of daily wear and the velcro no longer sticks. Obviously I'm not best pleased about this (although everything else is top notch about them) I've been left with leather flapping about which catches on the pegs etc.

Now I've not been able to get hold of them today and was just wondering what I can expect from Custom Lids' customer service. Will they try and fob me off with excuses or will they repair (can't really do without as its my only mode of transport) or replace them?

doesnt the sale of goods act say they should be fit for purpose and reasonable quality? the minimum you should expect is a replacement with a great big apology.

Relevant or Related Legislation: Sale of Goods Act 1979. Supply of Goods and Services Act 1982. Sale and Supply of Goods Act 1994. The Sale and Supply of Goods to Consumers Regulations 2002.

Key Facts:

• Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

• Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.

• Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.

• It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.

• If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)

• For up to six years after purchase (five years from discovery in Scotland) purchasers can demand damages (which a court would equate to the cost of a repair or replacement).

• A purchaser who is a consumer, i.e. is not buying in the course of a business, can alternatively request a repair or replacement.

• If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit

• In general, the onus is on all purchasers to prove the goods did not conform to contract (e.g. was inherently faulty) and should have reasonably lasted until this point in time (i.e. perishable goods do not last for six years).

• If a consumer chooses to request a repair or replacement, then for the first six months after purchase it will be for the retailer to prove the goods did conform to contract (e.g. were not inherently faulty)

• After six months and until the end of the six years, it is for the consumer to prove the lack of conformity.

The zip bust on my smx's so i took them back to M&P. They sent the boot to Italy and a few months later it came back with a new zip, cleaned leather, new slider and a new sole.

Great, except it took a month or so and i ended up with a "almost new" boot and a scruffy looking one.

Expect them to be fixed, but you'll be without them for a month at least.

The zip went on mine a few months ago.....I still haven't got them fixed.

I brought them from jsaccesories and they said their returns policy is only for a month, I'd only had them about 6/7 months.....

I had a pair of Sidi boots for 13 months and had slid down the road in them and they still got replaced when the zip was knackered. Razz

you get a years warranty unless stated. there returns policy is probably for people who buy stuff don't use it and bring it back. faulty items are covered for a year at least.

Spoken to Custom Lids today, they told me where I could get them repaired (for a price!), so I said no they're still under warranty I want them repaired for free! After a bit of moaning they've very reluctantly said they'll send them back to Italy for a repair Sad

I think I'll have to try my luck for a replacement when I go down to the store in person Thumbs Up

Don't know what Alpinestars policy is but when the zip broke in my Sidi boots (3 times Mad ) they didn't attempt to repair them, they replaced them each time with a brand new pair. Thumbs Up Cool

I had the stiching fail on my Alpinestars and Collin Collins of Harrow just swapped them over with a new pair for me. I think that was after about 3 months.

I have had these boots for nearly three years now and, like most people with AlpineStar boots, have had the velcro fail on me.

I bought some heavy duty velcro from Ebay, removed the old duff velcro and stuck the new velcro on with Araldite. They're like a new pair of boots now. Mr. Green
