(sorry its a bit long but its complicated, please please read)

so... It was st. george's day at the weekend. My girlfriend is spanish, and in spain on st. georges its traditional for lads to send their girlfriends a single rose and for girls to send them a book in return (dont ask me).

I, being a muppet, forgot about this until saturday, when I rushed online and tried to get a rose delivered to her on sunday, nowhere did sunday deliveries but I found a website (www.floraqueen.com) that delivered on saturdays, so I quickly filled an order form, requested it to be delivered the same day and placed the order. Recieved an order confirmation email just after stating what I ordered, where it would be delivered and saying it would be delivered today (saturday).

Flower doesn't arrive. No note or anything. Sunday comes, she has no rose, shes a little upset but she understands, but I'm pissed off.
Monday morning, I get an email from the flower people saying that my item has been successfully delivered!! so I email them and complain, woman replies and says some bullshit excuse for the 'its been delivered' email (that just means its in the system or something) and says that if I read the small print, orders have to be placed before 1pm (destination time) to be delivered the same day. I ordered it at about 12.45 english time so it wasnt like last thing at night or something.

But I was in a rush, didnt read small print, I figured the website wouldnt of let me place the order (and send me an email confirming it) if the delivery date I specified was impossible. I said this and havent had a further reply. I emailed again to demand my money back, or at least reshedule delivery of the flower.

so.... what do I do? the situation as it stands is they took my money (45 euros) and havent sent the item, despite sending an email claiming to have done so. What do I do? surely this classes as fraud? who do I complain to in order to get them done and get my money back?
please, I need advice. I refuse to let them get away with it on principle, its bad enough that the ocassion was ruined without getting ripped off as well.

I e-mailed them again basically saying the situation was unacceptable and I wanted a refund or I'd take it further.... then I get an email an hour later saying that my money will be refunded, which I suppose is good of them. Doubt I would of heard anything otherwise though.

You ordered it 12:45 UK time and the order had to be in before 1pm Destination time, this was in Spain?

You know they're still an hour ahead of us, right? So you actually placed the order at 1:45 local time to them. Wink

yeah I know... well actually the order was to be delivered in Nice (france) where she's working, but its irrelevant because the time there is the same as spain.
Its true though, if I'd clicked the 'delivery terms' link and read the small print (and I should of done) I would of known this. But my argument was that surely the email from them confirming that it was going to be delivered on the saturday constitutes some kind of formal agreement or contract. The website should have something coded to stop muppets like me from placing the order if the chosen delivery date is in fact impossible, if you see what I mean. But anyway, in the end the item wasn't delivered at all despite them trying to claim it had been.... so this stopped being the issue Smile
