I have just gotten a 2006 R1 so naturally everything is stock including the 2 tail pipes. Now for me half the fun is the noise, THE LOUDER THE BETTER, so I went ahead and modified the stock pipes by removing the inner canister and replacing it with a pipe wrapped with Vance&Hines Packing fiberglass. It sounds a lot better, but boy...... as I was working on this mod I found myself looking at the bike without tail pipes at all so I could not resist and turned it on.... WHAT A NICE NOIIIIIISE
Some ppl told me that you can empty it all out as long as you have a coupla feet of pipe after your collectors, some other ppl seem to believe that you must have some packing in there to generate some back pressure.
What is your view AND WHY....?

You need some back pressure or you will reduce your torque considerably. I am not sure how you would stand legally without a silencer at all. I know tractors get away with it, but the old bill tend to turn a blind eye to the chrome and tassles brigade. Rice burners tend to be open season though.
