...did something a bit silly in the car at 12 last night, had a copper knocking at my door at 9am this morning. My dad came out and a friend came round and the situation escalated, 3 more police cars turned up, i got arrested and my cars been impounded.

After spending a few hours in the cells finally my solicitor turned up and basically confirmed the worst, so now i'm currently being charged with failure to stop after an rta and 3 points for each front tyre (although the car was parked up when they checked the tyres, can they still do me for that?) Not really in the best of moods. Evil or Very Mad

Still waiting for a nip to turn up after a camera van got me doing well over a ton on a dual carrigeway as well.

Proper shit week. Thumbs Down

'A bit silly'?

Are you going to elaborate on that all, within the constraints of not incriminating yourself further? If not, it certainly seems that VTR isn't that far off the mark!

Afraid im in the same boat with you Dom_. But ive got a slight chance.

I was on my way to work, had a car pilled right up my arse along a 40mph road. Was probably only doing about 40 - 45 aswell.

When Drivers get on my tailgate they really piss me off, and I seem to really keep an eye on them.
Anyway, was comming along this road, round a sweeping bend, to a Zebra X`ing.

To my supprise, as I looked forward, there was a geeza about 2/3 the way across the road (on my side). Slamming on would of caused a prang from the motor behind me.
Quick glance to other carrage way, No oncomming traffic, So i swerved round the Pedestrain.

Now there are No skid marks at the scene, My tyres didnt screach, So I wanst being a complete idiot.

BUT ive been reported for Reckless driving, 2 coppers turned up at me house with an arrest warrant.
I was at work thank god, Dad sorted out the situation.

The downside is, THe bloke has an Eye witness. Evil or Very Mad
I was by myself in the car, so its my word agains the 2 of them.

They have my licence, and they are still deciding what to do with it. Sad

Good luck anymate. As my dad said to me. Whats done is done. take it on the chin. Accept the Ban (if you get one). Give it a year, go on that Driving Rehab course. And retake your licence.

Its just gona be a year or so of utter shit with no car. Thumbs Down

I would have thought that when it comes to court, having someone tail-gating you would be mitigation to a certain degree. If you can persuade the bench that you were justifiably distracted by the driver behind's antics, then you might get a better deal. That said, their response will probably be that if you were worried about him being too close, you should've slowed down. Worth a try though, eh?

Mr james. Its all going to be a bit weird at Court because the bloke on my tailgate is the eye witness! Shocked

So as he is sticking up for this guy saying I "nearly hit him". I shall be saying how it was him who was on my arse end who almost caused the incident.

But then the 2 will probably stick together and just wipe one and others shitty arses!

Ah I duno, I Will probably get 3 Pts and £60.
That makes 6. Sad

I will be on my FINAL straw then...

You'll obviously have to accept in court that you almost hit the pedestrian, but hopefully that frankness will add some credibility to your assertion that the guy behind was a serious distraction.

As I said, I doubt it will get you off the hook, but they might go a little easier on you!

Where did anyone say that the tyres were knackered ? Do you actually know why they are "doing him" for his front two tyres ?

For all we know they could have found that they tyres had a tread depth of 1.5 mm instead of 1.6 mm, or perhaps the tread depth was over 1.6 mm but only across 74% of the tyre instead of 75%. Neither of which would actually matter if the roads were dry.

You don't know what happened, so how about not embellishing the story until you do.

Well if that's the case then maybe bring up in court that he/she was the person that was tailgating you and not following the "two car legnth" rule. (Pointing at them helps too Smile) Then maybe if you can get him/her to admit it the jury may go easier Confused

All the best either way mate Thumbs Up

Was the car parked on the road when they checked the tyres? If it was, you're screwed for those too (2pts each as I remember).

If it was on a private driveway. They are going to have a hard time doing anything about it, especially with an even vaguely competant defence brief.

Failure to stop and report is a biggie though.

For what it's worth, they've tried to pin that on me twice now, in both circumstances unjustified.

The first time I knocked over a pedestrian, exchanged details then went to the local cop-shop to report it. By the time I got home (maybe 45 mins after the accident), there were two coppers sat in the kitchen at my folks house (which is a 20 minute drive from the nearest police station) ready to arrest me. I was able to fuck them right off over the phone by quoting the incident report number at them.

Second time was on Hartside pass, a sheep ran into my bike (going very slowly, I knew what it was going to do). Got pulled by four coppers in three vehicles on my way back down the pass. Tried to do me for failure to stop and report. I could see where it was heading and managed to lay a verbal trap which left the sergeant who was conducting matters looking like a fool. Culminated in:

"For all you know, the sheep could have been suffering from stress."
*BINGO!*
"Well officer. In my professional oppinion, it wasn't."

All depends what you did, but that's twice they were at the point where they were going to arrest me and I was able to give them the metaphorical finger. Someone else might not have been so lucky in similar circumstances (especially the sheep one, if I hadn't been a vet with a good working knowledge of the law regarding animal RTAs, I'd have been in the back of the police car.).

Police don't give 3points out for Perfect tyres do they? If they are 1.5mm they are knackered and should have been replaced. I don't know what the condition of them was but for points to be given they must be far from perfect. Thats why tyres should be checked every week to make sure they are road legal. Its the law, you take your chances and if it goes tits up it will bite you on the ass. I have been given points for Tyres through a knackered ball joint throwing the tracking out. My fault for not making sure they were legal.

tread depth is only dangerous in the wet

otherwise its just a legal thing

however sounds like dom knows he was in the wrong for the rta

binge needs to realise that if someone is tailgating you, you slow down to reduce your risk with the added bonus that they might overtake and be off ur arse

i know its tempting to keep glaring at the guy who is annoying you, but if your eyes werent on the road, it may well have been dangerous driving

im a bit curious how things escalated to 3 police cars

doubt that will help u much

No you won't. That will be a lost licence if you are still in your 2 years probational period.

You CANNOT accumalate 6 points within your probation.

You will go back to your provisional and take your test again.

https://www.thinkroadsafety.gov.uk/advice/pdf/novicedrivers01.pdf#search=%222%20year%20driving%20licence%20probation%206%20points%22

Dom_ Failing to stop after an accident is 5-10 points. If in probation you will most likely lose your licence.

Dont be so fucking stupid, when a tyre gets to the end of its life, specially bike tyres they becomes very hard, i had a Rennsport trackday tyre on my gsxr and even on dry days it would spin up fairly often.
Fitted a new far far less sticky tyre with actuall tread and it never did.

Sticky bike tyres are a lot more susceptable to heat cycles.
I often find my front supercorsas go off when there's still plenty of tread left.

However other tyres that aren't as sticky, or the SCs used by people that don't abuse them as much, stay with similar grip for longer.

From what I've seen, car tyres don't suffer nearly as much; though, despite comments that I drive like I ride, I doubt I've ever seriously pushed car tyres for a sustained period.

A worn car tyre is less effective than a new one, but quite a margin, and particularly on decent brand name tyres. I generally find that braking distance is 50%+ more on tyres that are near the wear marker than new tyres.

I don't know why, but I assume its down to having less rubber there to absorb the heat, and less rubber to flex and give a decent contact patch with the road.
