Hiya,

Right I went out to Leeds last saturday night. I parked my car near the indoor market on the street in an area where there was no visible road markings or signs to indicate it was a pay and display area.

On returning during the day I realised I had a ticket, however in day light I could still see no visible signs and the road markings to indicate a parking bay were so worn out that they were barely visible.

Does anyone know where I stand with regards to this as I wish to appeal on the basis that it was not clearly marked as P & D.

Cheers Siggi,

Unfortunately that'll involve a drive through to leeds, which will set me back a tenner in fuel plus time. What I've done instead is write a letter stating that it wasn;t clearly marked and if they decline my appeal that I will aggressively chase the issue through the correct legal channels and collect the evidence then.

I'm hoping they will either meet me in the middle (say an admin fee of £15, which I'll accept since it saves me time) or drop it all together.

If not then I'll nip through and get the photos. I can't see them taking one punters letter seriously enough to rectify the problem so it'll be the same a month from now as it was last week.

Worse case scenario, and it was marked and I didn't notice....well I delayed the bastards long enough that I can pay at the end of the month and not suffer the full £60 fee.

You'll more than likely receive a pre-written letter telling you how you are wrong and still need to pay. No one will properly read your arguement.

You've got to be pretty dedicated and prepared to spend alot more time than it's worth to change anything. It's frustrating but unless you're retired and have nothing better to do, it's easier and cheaper to just pay up. The people handing out the tickets have ages to play the legal game, you just want it out of your way.

So much for being innocent until proven guilty etc

I dunno, I got a aprking ticket in York. I appealled and they requested a form showing that I had called out the RAC. I provided it and they let me off.

Not challenging the system sometimes leads us to believe its futile.

challenge it ie siggi's way or pay the ticket there IS no middle ground in this situation , you send a letter it'll go right into the bin,

Bury has had some massive victories from challengers , one with a parking attendant photoshopping his evidence photos which got 3 years worth of tickets cancelled (and caused a 1.5million budget deficit to boot).

So don't be surprised when you do go back there are signs and fresh paint. That's me being cynical of course but IMO they'd rather spend money and do that than admit they're wrong.

FWIW was in Maidenhead at the weekend and saw lots of double yellow lines that were in such bad condition or had tarmac patches breaking them up that anyone could have parked on them and being ok. FWIW the lines have to be continous and correctly terminated. Always worth checking.

As a quick tip it's worth keeping one of those disposable cameras in the car/bike for just such an eent or in case of an accident. They're better than digital as can't be argued the negative has been digitally altered.

Just some thoughts.

I keep one with me all the time cost me next to nothing , its not so useful after a drive away though , since the opposing party just drives right off while you are still sliding across the road.

I suggest you protest. I've had four parking tickets and had them all overturned on protest. The circumstances were different, but many councils have more than half their parking fines overturned when there's a complaint.
