Hi
Unfortunatly not.
I agree that the SORN system is totally useless.
If they chase you up what they do is take you to the small claims court for failure to pay (and a court miles from where you live). Idea is that the penalty is assumed to be correct and you are not in a position to argue against it, added to which you will get a CCJ against your name.
All the best

YES YOU CAN! tell them you sent off the SORN letter (that came with the tax reminder) a couple of weeks before the tax was due, and that you presume it got lost in the post or in their system, have a moan about their incompetence etc.
i have personally got off a fine this year using this method, and i know a handful of people who have done the same..
i'll have a look and see if i can find the letter i sent, and the one i got back.
i believe they HAVE to give you the benefit of the doubt if you protest, and all they will do is send you a new sorn form. remember to backdate the second form to the date it was due. this info came to me from someone with inside knowledge

Also if I am forced to pay the fine does anyone have any reccomendation's about who to contact to reclaim my money and challenge the whole SORN system, which is a form of bullying and theft.
P.S. I realise going to the post office would have been simpler in the first place but I forgot to do so. I see no reason why I should be punished for forgetting to do something the government imply's I should. The vehicle was not used on the road, as it is not roadworthy, I have the previous year's SORN so it is merely an error.
Thanks for any help. |
I also received a similar request 12 mths ago, and I, like you, had forgotten to post it
However, I gave them a call and "wanted to know what this demand was for" and I had posted it to them "Ages ago"
Few umms amd rrrsss and low and behold, they cancelled the fine. It must have been due to Mr Postman not delivering, after all, they lose 1.5 million letters a week, mine must have bee one of them |

Have got off 3 or 4 of these for a car i sold on but 'forgot' to inform the dvla, ranged from no tax to parking tickets. I even let it run to the summons stage before phoning them in exasperation quoting the numerous correspondance and phone calls i had made.
All dropped and no problems
*edit* i had sold it on btw, just kept forgetting to send the form ____________________ Fallen Angel "Nae sniffing my seat now!!!!! "

I'm afraid i can't offer any help, but i'd just like to join in the rant.
I hate the idea of assumed criminality - 'you haven't told us it's off the road, therefore you are using an untaxed vehicle and therefore are a criminal'
Bollox!
It's like the friggin TV licence - i don't own a TV, and therefore don't have a TV licence. I received numerous threatening letters from the TV licence people saying they would send a copper round to 'interview me under caution' for operating a TV without a licence. Eventually i told them that if they continued to threaten me i would contact my MP about 'harrasment from a public body' - not heard anything from them since.

To add to this also, I sold my 50 a month or so back, And i forgot to SORN it beforehand...
They sent out the letter (please pay the fine blah blah) and included the form to SORN it...I filled it in and sent it off, Then 2 weeks later i get another letter (thankyou for informing us you've sold it)
I think ive got away with it... ____________________ www.oldskoolsuzuki.info |

So if I filled in the SORN declaration and sent it off after my tax disc expired, would my bullshitting capabilities as far as the fine for being untaxed for a period be pretty much out the window? They want me to pay them £90. |

Im sorry to say this but you wont get anywhere if you try and take this further, you will just be digging yourself a hole. As far as their concernd you have no grounds to stand on, you forgot to renew your sorn and thats down to you. id just pay the fine and renew it asap, leave it longer the fine increases i believe.
I was sent one for my last bike which was a write of, i phoned the dvla and told them that and they simply said get a signed letter from the insurance company saying they have it and that will be fine, did that and 4 months later i receive a SORN notice saying i have to pay a fine. So sent another copy showing the date the letter was received on recorded delivery and then they sent me a letter saying they are not going to pursue me any further on this. But i was able to persue this because i did send them the letter with plenty of notice originally.
I think the sorn system is rubbish because people that have taxed the bike previously but then have taken it of the road are getting fined just so they can catch the people without tax on the road. ____________________ My Bike Pics |

I've got a similar problem.
Sold a car back in July. It had tax until August and MOT for the same.
The guy I sold it to got in touch with me abotu 4 weeks ago asking if I'd sent the V5, which I had done, 2 days after selling it.
Now the DVLA have fined me £40 for not taxing the vehicle and demanding the guys address.
I've phoned them up complaining that I had sent off the V5 months ago, and that this is a direct resul of their, or the Post Offices incompetance.
It now stands that as the fine is being disputed I dont have to pay (yet) but I need to ge tthe guys address details.
The DVLA are a useless bunch of c*nts, like many government agencies. So much paperwork and procedure, even the people who work there dont have a clue.
I agree, the SORN system is a pile of cack. ____________________ Like a Yorkie - I'm not for the girls |
