travelling to work on tuesday, the van in front turned left, so i passed him on the right side of the lane, when some stupid driver pulled out, swerved but didnt manage to miss. slid down the road, ripped off the gear change and ripped open my gloves, making a mess of my fingers in the process.
th woman told me she saw mer but didnt think i would pass the van, im pretty sure shes at fault and shes landed her self in it by admiting she saw me and still pulled out.
wasnt even like it was busy and she was nipping out between traffic, and it was a nice wide straight road with good visibility. cant understand why she took the risk? ah well, let the insurance take it form here

Its not overtaking at a junction.

Had this happen to me 9 years ago. Paid out £3000 for 5 days off of work. Driver convicted for driving without due care.

Im sorry mate but IMO it was your fault , the police would say that you should have been more patient and waited for then van to pull off fully.

Tough call IMO.

I think it's her fault as it's her perogative to pull out in good time etc.

But then you were overtaking on a junction.

I think she's 100% at fault, worst case 50/50, maybe 75/25 is likely.

I wouldn't want any legal advice from anyone here.

She pulled out, failed to give way, didn't have a full view of the road, it was blocked by the turning vehicle. Its called driving without due care and attention, one of the most clear cut cases I've ever heard.

thing is i passed the van as it was turning, not waiting for queing traffic. wasnt like she would have had enough time even if i stayed behind. all a bit of a minefield at the moment, i'll have to see how the insurance see it
