Picture it.

A biker is speeding. a good 20mph over the speed limit or somthing.

He comes to a junction and a car driver pulls out without looking. A crash happens.

Whos fault is it?

75-car
25-bike,

I reckon

since investigators will be able to tell how fast you are going by the damage , inflicted , but I read somewhere that speed alone is not seen as negligence.

worst cast 50-50

But the driver would probably be done for driving without due care or attention 6pointer, thats IF he stops since you ding him , his car can still move , bike dings car bent forks mean your stuck.

that said he can't use the defence against you that you were speeding , because how would he know ? , unless he saw you , if he saw you and still pulled out then he pushes the driving without due care and attention to reckless driving 6points->ban big fine

Obviously its down to both of them, But I would say the biker as if he were going at the speed limit he would have a better chance to stop in time should the driver pull out.

wouldnt the blame be split even though, the car would still be able to see the bike comming if they looked ? Confused

If the car driver isn't looking then a bike would be likely to hit him at the posted limmit (without rideing defensively that is)

Allthough a vehicle (bike in this case) at the limmit has greater chance of stopping the slower its going

Depends too much on the situation, some speed limmits arround here are outlandishly low for no good reason, some if you rode at the limmit for most of the road you'd not last long..

Allways assume they are going to pull out, keep an escape route free, watch for eye contact (or lack of) and watch their wheels (if the front wheel dosn't come to a complete stop they are balanceing it on the clutch, no brake, so if their foot slips then they could fly out into the road, it also shows they dont plan on staying stopped for any length of time)

Just little things, but on many occasions its saved me from becomeing a volvo ornament.

I'd put it at 50/50. The car driver should be certain that there is enough space before pulling out, but equally the fact that the bike is 20mph over the limit will not make it easy for the driver to make an accurate assesment. Also, if the bike is going too fast it will be harder to take avoiding action/stop.

The councils fault for not putting speed ramps on the road by the junction, if its a black spot there should be a speed scamera there too, just for good measure. Thumbs Up

Apply the truck rule.

Would the cager have pulled out if it were a 30 ton truck instead of a bike? If no, it's 100% the driver's fault.

Over the years I've known a lot of bikers that have had accidents and have had real problems proving that they weren't partly to blame when involved in an accident. So many witnesses say a biker is speeding even when he/she isn't.
With that in mind, I reckon the biker is 50% to blame even before the accident has happened. He really was speeding so therefore I reckon 75% to blame. The car drivers solicitor will feel a wee bit sorry for the biker so offer about £250 out of court settlement rather than see the biker getting banned for dangerous driving and going to prison for 6 months.
