As a few people will remember i was taken off my rvf400 on april 5th of this year. A pickup truck swerved into the left handside of me half way across a junction when he realised he was in the wrong lane. After the accident i was left with my foot impaled to my foot peg with cartoon style blood effects. The driver stopped gave me and my witness a mobile number and his first name and then pissed of.
The police arrived called him up and made me him come back to the scene. By this time i was in the ambulance arranging for my bike to be picked up. The police took my statement/my witnesses and his, recording the accident and his vehicles details. The police told me he was insured and that in his statement he said he was changing lanes and didnt see me.
Now i assumed this would be a simple matter, id heal get out of hospital and then the police would give me all his details because i wasnt able to get them at the scene (due to cartoon blood effects).

My insurers quickly set me up with a solicitor and i received a letter from the metropolition police stating it was being investigated and to answer a producer. After answering my producer i was then accused of failing to do so by letter (a mistake by my local station).

Cheerfully ringing then supplyed number on the police letter i politely asked for the other drivers details so i could begin legal action to be told that id have to request the details in writing, pressing the call person he did a check and could only confirm the truck had no insurance as of now....

My solicitor fired off a letter requesting the simple details i was due from the accident, a month passed nothing. I tried calling the number but was always left hanging, my solictor sent another letter and have as yet 3 months later not received a single reply. Now calling the number gets the response "we are unable to take phone enquires at present please write to us at the following address....."

I am realy starting to lose my patience with the police, i still cant walk and need to start the insurance action and they wont even tell me his registeration or if hes even insured! Surely im legaly entitled to the details of who hit me?

If your solicitor hasn't even managed to get the details of the other person that was involved in the accident from the police in 3 months, I really think you ought to consider getting a new solicitor!

Is your solicitor never available to talk to you? Never returns your calls? Have you been given the name of someone to complain to? 6. Once you have told your present solicitors you don’t want them any more and signed a General Release Form for your new solicitors to get your file from the old solicitors, you should be able to leave everything to the new solicitors. They should be able to advise you on costs, Conditional Fee Agreements and legal expenses insurance. They should also contact the other driver’s insurer.

REMEMBER:
If you want to change your solicitor the sooner after your accident you do so the better. We cannot undo an agreement to split liability or to accept a certain sum of money in compensation. At that stage it is too late. If investigative work needs to be done it’s best to do it before the witnesses have forgotten what they saw. If in doubt,
