Had them 2 weeks. Done around 250 miles in them... if that.

Went to put them on earlier for a ride out.

Noticed the double stitched seams behind the knee, by the flexi section, burst.

WTF.

Will be taking the two piece back tomoro. Paid £495 for them. Wasnt 100% happy with them anyway as they are meant to be red/black and the red is more like dayglo orange.

do you reckon the shop will attempt to give me a credit note or will attempt to have them repaired? I dont want them full stop, wouldn't feel safe in them.

tell them to stick them if they come off like that id think the whole thing will be the same and in a crash well id rather not be wearing them as they will pop apart Crying or Very sad what shop you get them from ?

They're clearly faulty, I reckon you're within your rights to demand a refund. As above, had you actually "tested" them, it could have been very nasty!

just out of interest, what make of leathers are they? Just so I can avoid them . . .

bought at proto, top of west gate hill.

leathers are Spyke Bull Bear - and should be fecking excellent.

They were a tight fit, which is what I wanted, if they have burst instead of stretching, imagine what would happen to them bouncing along tarmac at a ton. I would have been fucked.

Two phrases to use: "Not fit for the purpose intended." and "Not of merchentable quality.".

I would have said that you are entitled to a replacement or your money back under the sale of goods act (which is where those phrases are from).

You do not have to accept a credit note if returning faulty goods.

quite right.
he's well within his rights for a refund as the goods are unfit for the purpose they are advertised and sold for.
if you want a refund and they get shirty about it, print off a copy of the act and take it with you to back you up.

As a side note I wouldn't mention that you're not happy with the colour, otherwise the shop may get funny and say you damaged them so you could return them etc.

yes mate, it is.

So. went back to the shop today with my brother, as he wanted kitted out for his 125 aswell as taking my Spyke 2 piece backl.

Shop manager refused to refund the money. Said that they would repair them while I waited. I said I didnt Trust the suit. He said he would replace them but would have to order them in. I said again I just wanted a refund. He refused to refund the cash. Said he would have to send them back to spyke/feridax to see if they would refund the money to him. I ranted on about consumer rights, not fit for purpose blah blah blah and he wouldnt budge, said I could ring trading standards if i wanted to. Blew my stack with him and in the end he said he would let me choose anything in the store for the same money - I paid an additional £50 for a Sidi Two piece.

He waited until he had served every other customer and they had left the shop before bullshitting with me though. carfty little fecker knew he was going to fight it out.

Perhaps it was my attitude that got his back up initially? I was pissed off in any event as I wanted to go for a birthday ride with my kid bro but his 125 cover note didnt turn up this morning so we cant tax it.

Mind you though, we kitted my brother out with boots, gloves, skid lid, jacket and trousers for £390. The shop is usualy very good.

Very happy with my Sidi two piece.

The shop is Proto at the top of Westgate Hill, Newcastle. Young Asian lad, mid to late 20's seems to run the shop - they have a shop in Darlington aswell and one elsewhere - he reckon'd it was there policy and it had been like that for 10 years and it wasnt going to change just for me. I thought he was a cheeky little cunt.

So while we were happy to get the gear for the 125 at good prices, I won't be going back to get any fast road stuff from the little teabag.

carl i got told from every shop on west gate road not to touch them even hein said it, they use old stock from what i got told so give your sidi suit a good tug and see if that bursts if it does go back with a bat and a mask

Shocked I wouldn't have bought more from them. I understand it can be intimidating argueing it out but in those situations you have to stand your ground. Even if it means walking away to think your next move though.

Big companies are usually quite good about this sort of thing. I bet if you'd contacted Spyke directly and told them the story plus mentioned that others on your regular forum thought it was a poor state of affairs (threat of bad publicity without any actual threat.) They would have sorted you out with ample compensation, perhaps a higher priced replacement. I always got the impression that they were a decent quality make, i'm sure they want to hold on to that rep.

Thinking about itmore, the old stock thing sort of conicides with the colour being not what you expected. The orange could have been red once upon a time.

I would have got my mobile out there and then. For future reference, the people at trading standards are very helpful.

The guy sounds like a total shyster, your contract of sale was with HIM not with the people who made the suit. He gives you your money back then it is up to him to get his money back off the manufacturer, that's how it works.

yeah, i know what you mean, but the gear we bought wasnt fast road stuff, just scooter type wear - good protection enough up to 70mph and the stuff was cheaper than most other places for that range.

So you actually rang them in the shop while he was there? what did they say? I'm willing to bet it wasn't

Because that's what you've done, he'll just either repair those leathers and sell them again or return them to the manufacturer and get a refund. Meanwhile he has another £50 of your hard-earned.

no mate, i didnt actualy call them, i was going to to see if he would react, but he didnt care.

what was i to do? walk away and ride in my y fronts? he said all he could do was send them back to spyke and await their decision on a refund - i couldnt walk away with no cash or a road suit.

it's easy sitting at your keyboard to commentate but when ur in the situation you have to accept the mutually agreeable solution - I got a better suit for £50 more.

i've reported him anyway for selling seconds and refusing a refund - though as I accepted a replacement I now have no rights with regards to the spyke suit - he cant repair them as i melted the finish on the knee on the exhaust... Laughing I have to wait until the spidi's show a defect before it affects the current guarantee.

I'm V.happy with the spidi leathers tho.
