Last week i went out car shopping found one i liked. They guy valued my car and gave me a price to change, rarther then price for car part ex price... I just asked for the bottom line thats what i got. So i paid a deposit and arange to pick the new car up on friday.
I got a phone call today from garage saying they HPI checked my old car (p reg) and found that years ago it was rechorded as a Cat C write off. Because of this he wants an extra £300 to make the swap.
He didnt ask about accidents or say the deal was subject to a clear HPI check, and as i didnt know about the accident I wasnt missleading him in any way.
My point is does the dealership have any rights to demande the extra £300 as i have a signed agreament, by both parties, of a "price to change" with no mention of my cars history or a HPI check.

I would have thought the once you've signed the contract you are bound by it, however the small print may mention terms and conditions.

I think it will depend on exactly what is in the agreement, but I would expect there to be a clause for them to wiggle on.

The terms state that before an agreement can be made the seller (ford) will inspect the part exchange vehical to determin its value. It then carries on to say that when i sign i agree to deliver the part ex car within 7 days of recept of my new car in the contdtion that it was valued in.
No mention of further checks after a value has been agreed.

One of my mates had a similar problem, he used his battered old fiesta as part ex. On the day he was due to pick up his two year old Alfa 147, the alternator went, it cut out so I had to recover it.

We tried to charge the battery, hoping it would last long enough for hm to get his keys and leave.

Unfortunately there wasn't enough time for a proper charge.

Needless to say, it arrived at the dealer on the back of my truck. Straight away the salesman was moaning, he went away and wanted £100 off of us. Now, if it were I, and bearing in mind this was a totally cash sale, I would've walked out. My mate was gutted, he doesn't have credit cards and certainly never had the additional cash on him.

In the end I stumped it up for him, lets be honest all the dealership's going to do is charge the battery up and sling it in the auctions.

I guess, from my point of view is, I push it to the absolute limit with the dealer to get them to drop it. We did it with one of out vans, We went to pick up a brand new £13000 citroen, all striped up with beacons drilled through the roof, something wasn't quite right with the finance deal, we got up to leave. Cue a very worried saleman!

We got what we wanted.... Laughing

must agree, be prepared to walk away, chances are he will stick to original deal.

After a day of phone calls back and forth with there legal team they came back and said they would do the original deal if i paid an extra £100. So all this fuss over £100 to a dealer who will sell millions in cars in a year!

pay your £100 as you are unlikely to find another dealer who will miss the experian/hpi check, and most likely refuse to tke the car in part ex at all.

We refuse to even take in imports.

I know with us, you sign one agreement to say your happy with the purhcase of your new car, and another to do with part ex (mileage is correct, no finance outstanding, never been recorded as total loss), if this is the case, your stumped.

However, I'd be very suprised if the dealer was going to lose a deal over this (especially if it's a brand new car, or maybe if it's already been registered in your name?).

What car is it out of curiosity? To be totally truthful, there's not many run of the mill P reg cars that are worth more than a couple of hundred quid anyway (Part ex I mean).

In the end after all this fuss they got £25 extra from me. Was it realy worth it?
And yes i was traiding my p-reg laguna in against a second hand focus.
