I've been pursuing my charges from my bank recently, I wrote to them asking nicely for my money back and they (unsurprisingly) refused point blank.

So I promptly filed a court action to which they have until August the 1st to file a defence, hopefully it will go no further and they will buckle and pay up the £580 they owe me Smile

Check out www.bankactiongroup.com and pop over to the forums for all the information you need Thumbs Up

I sent a few nasty letters to the customer service deparmant informing them that the charges were illegal and in the final letter l stated that l would be taking court action if they did,nt reply within 14 days, in the end they re-funded the money.

I,ve had loads of troble with HSBC the last time was over £500 being stolen out of my account when my card was cloned and HSBC had the balls to call up four times threating me with court action for being pass my overdraft by £400 while the cloning was being investaged each time they called the more abusive l got till the cu*ts stopped calling Twisted Evil

I'm just claiming £365 back, hopefully they'll pay straight up. Some people are claiming up to £5000 and some more!! and they're getting paid it too!! when it comes down to it, the bank is in the wrong and they would rather pay you than the more expensive court costs involved even if they don't win.. be careful though as you might get your account closed... Yes and then they'll cancel your bank account with them. Which they are entitled to do.

So get ahead and get another account sorted.

On another note, it does look like charges are coming down, I got an email from my credit card firm to say they were halving all fees.

Whilst they can do this, and sometimes might do, normally.. they wont... as some fees such as service fees and interest etc are legit so if the bank close your account they are losing out on your business.. so most of the time they won't close your account, depends on how much you're claiming for I think... but it is always worth having a parachute account ready (another account basically..) so you wont have any problems getting another account IF they did close your account.

Let me get this straight. Were you overspending on your account and now dont want to pay interest on your overdrafts?

No mate, the interest on my overdraught doesn't bother me as it's only pennies.

What I have a problem with is that while I was experiencing sever financial difficulties when I was younger the bank were taking up to £100 a month in charges from my account for being £2 overdrawn etc....

I appreciate that I'm responsible for keeping my bank in the black I'm not going to subsidise free banking in the UK by paying unlawful charges.

Read www.bankactiongroup.com it states very clearly what a bank can lawfuly charge. They've been using their monopoly to cream off money from the people who can afford it the least.

I'm claiming £400 from Capital One. A week or 2 ago I sent them a letter saying that I would be taking them to court (they ignored my first letter). This morning I received a reply saying that although their charges are legal, they are prepared to give me £168 - the difference between their charges and the £12 that the OFT says is now fair - on the condition that I drop the complaint.

Yeah, like thats going to happen. Will keep you updated.

Do a lot of you guys have low credit ratings?

I'm just wondering if the fines were just a 'fee' or were actually getting noted somewhere?

Do you send the initial letter requesting details of charges you have paid to the bank HQ or to your 'home' branch?

I've been taking mine into my home branch and getting them to write me a note confirming that they have received it.

Also, anyone done this with Barclays?

I jumped on the bandwagon on another of my forums ...

HSBC

Claimed £709.50 over the last six years ...

... after a month's wait, received confirmation of £709.50, but suggesting £700.00 in settlement ...

... signed that and sent it off, cash should be back in my account before the end of the week ... Very Happy Thumbs Up

The fee are 'penalty' fees ... a common English Law precedent (by no means rstrcited or only related to banks) is that a party can't include a 'penalty' within a contract if that penalty is significantly greater than the actual cost or loss incurred.

Since automated fees (penalties) simply cost pence to administer, being tripped and applied automatically by computer ... any bank charging in excess of £10-£12 per trigger (the Banking ombudsmen came up with £12 being reasonable) would be batting on a sticky wicket.

And it's not just the difference (eg the 25-12=13) you can claim, it's the whole fee ... since it's the application of the 'penalty' that's unenforceable ...

Of the other forum, succes rate is about 100% ... unfortunately, some banks are fighting ... claim £1000 and they'll offer £500 to settle etc ... but, be resolute, and they'll cave ...

The only ones I've seen close accounts are Society accounts.

If you can demonstrate it, there's also a legitimate basis to claim for any interest on the effect of the charges too ... although a lot of banks ignore the 'extra' overdraft created by charges, you'd have to be very careful ...

Bear this in mind; no bank has yet allowed themselves get taken to the Small Claim/ Money Court ...

Claims have been pitched by letter to the address on your chequebook ... and also to customer services on online accounts ... all successful ... mail is slower though, the online email approach seems marginally quicker ...

Have a look here https://www.consumeractiongroup.co.uk/forum/ as well. They have templates for all of the letters you need to send, and will help you through it.

I started a claim against Lloyds in march, and received a settlement letter yesterday for £3500. I went all the way, but they are settling a month before the actual court date. Very Happy

The way I see it, you have nothing to lose, and potentially a lot to gain. Give it a go!
